Michigan is a no-fault state, which means that drivers are required to have personal injury protection (PIP) coverage on their auto insurance policies. PIP coverage pays for medical expenses, lost wages, and other expenses related to an auto accident, regardless of who was at fault. Michigan PIP claims can be complex and challenging, especially for insurance companies. The state’s no-fault laws are constantly evolving, and there are a number of traps that insurance companies can fall into if they are not careful.

In a case that necessitated a certified question from the Second Circuit to the Indiana Supreme Court, the state high court has answered the following certified questions thusly: First, is an insurance policy that provides automobile liability insurance in excess of a retained limit, as opposed to in excess of a primary liability insurance policy, a “commercial excess liability policy” within the meaning of Indiana Code section 27-7-5-2(d)? Second, if not, and an insurer issues an automobile liability policy with a $7 million liability limit applicable only after a $3 million retained limit is exhausted, is that insurer’s statutory obligation to provide UIM coverage subject to a $3 million retained limit? The court answered both questions "no" finding the statute and the policy ambiguous and construing them in favor of the insured. There was a textualist dissent from Justice Slaughter joined by Justice Molter. The dispute comes down to what is excess insurance and whether a policy with a retained limit is excess insurance. The decision is is below and my post on the oral argument is in the comments along with Episodes 210 and 229 of the Podium and Panel Podcast where Dan Cotter and I discussed the case. 💰 You want to know why insurance premiums are so high? 💵 Cases like this might give you a clue: A lawsuit was recently filed in 2021 over a 1977 car accident. Yes, you read that right—an accident from 46 years ago. While the Michigan Appeals Court ruled against the plaintiff, the resources expended in litigation, discovery, and investigations on a decades-old event are a stark reminder of the ripple effects of frivolous lawsuits on insurance costs. In this case, neither side could produce conclusive evidence of a claim or policy dating back to 1977. Both parties extensively searched for answers, but unsurprisingly, files from nearly five decades ago weren’t available. The result? Court resources, legal teams, and time were spent untangling a situation with no clear resolution—all costs that trickle down to policyholders. How do you think cases like this, and other frivolous cases insurers face on a daily basis, affect the broader insurance industry? #booneofinformation #InsuranceLaw #LitigationCosts
