In my first opinion piece for the Bulletin of Atomic Scientists, I argue that Congress has a moral and fiscal responsibility to compensate individuals who were harmed by U.S nuclear weapons testing. “Last week, the Senate approved a significant bill to broaden and prolong the Radiation Exposure Compensation Act, achieving remarkable bipartisan support. How Can Defense Counsel Stop Nuclear Verdicts Fueled by “Answer an Ad” or “Briefcase of Money” Arguments by Plaintiff’s Counsel? Earlier this week I provided a demonstration of a common argument plaintiffs attorneys use in closing argument called “Answer an Ad” or “Briefcase of Money.” This argument is meant to fuel juror anger and make a nuclear award for pain and suffering seem reasonable to the jury. Check it out here: https://lnkd.in/g34-tTpA How could defense counsel respond in our closing argument? I took a stab at it here! FIRST - the defense’s goal every time we stand before the jury is to defuse juror anger, show the jury we care, and be the most reasonable person in the room. SECOND - The defense must offer this counterargument AFTER we have reframed noneconomic damages for the jury in closing. We must create our own narrative and offer our own assertive arguments for pain and suffering. The defense cannot stand up in closing and immediately jump to refuting or punching holes in plaintiff’s arguments. When we do this, we validate the plaintiff’s framework - meaning, the plaintiff has already won. Importantly, our framework must show the jury that the defense’s number is what is fair, reasonable, and is going to make the plaintiff whole again. (Later in this video series I’ll share a framework and two arguments the defense should use to argue pain and suffering in front of the jury - stay tuned!) With this backdrop, here is a suggestion from Tyson & Mendes on a way the defense could respond to plaintiff’s counsel’s “Answer an Ad” argument. I had the honor of working on a special team within our NRE department for this report to the Committee on Armed Services regarding the disposition of high-risk radioactive materials. These materials are commonly used for medical, industrial and research purposes—such as in the oil and gas industry. However, some of these materials have limited disposal pathways or may not have a pathway for disposal at all and can be dangerous if improperly used. We made 3 recommendations to the Chairman of the Nuclear Regulatory Commission and the Secretary of Energy which involved taking necessary actions to facilitate secure long term storage for certain sources until a permanent solution is available and to minimize the time that disused sources are in licensee’s possession. https://lnkd.in/gJPrXSxG

The fundamental safety objective — to protect people and the environment from harmful effects of ionizing radiation — applies to all circumstances that give rise to radiation risks. The safety principles are applicable, as relevant, throughout the entire lifetime of all facilities and activities, existing and new, utilized for peaceful purposes, and to protective actions to reduce existing radiation risks. They provide the basis for requirements and measures for the protection of people and the environment against radiation risks and for the safety of facilities and activities that give rise to those risks.
