Marie's article is a really good read. Practicing eCommerce law is both unique and challenging. We got into it because the major legal issues in eCommerce are directly related to our practice strengths: brand protection/trademark, business transactional, and forensic/investigative work (learned from my days as a prosecutor). But because not that many attorneys focus on this nascent industry, there is no "how to" book and we rely a great deal on what I learned in my last ten years of eCommerce experience.

The Finnish Data Protection Authority fined an IT retailer €856,000 for failing to set the retention period for customer data. The Finnish Data Protection Authority has been notified that the data controller requires customers to create an account in order to make online purchases. The Authority asked the data controller to explain why it was required to create a customer account, the purposes for processing the data and for how long it stored its customers' data. The data controller responded that the processing of customers' personal data is necessary for the performance of the contract and that, when customers are allowed to shop without an account, it is required to process and store the personal data required for order placement and delivery on an order-by-order basis and retains the personal data until the account is deleted at the request of the data subject. The Authority found that the creation of a customer account was not required as the processing of personal data relating to a single online purchase resulted in the data being stored for a long period of time, and the retention period was deliberately left indefinite. Consequently, the Authority reprimanded the controller, ordered the controller to define a reasonable retention period and to stop requiring the creation of a customer account, and imposed an administrative fine of EUR 856,000 pursuant to Article 83 GDPR.
