The Family-Focused Office One thing I learned at a recent The Family Firm Institute - FFI conference was the concept of a family-focused office (FFO). This holistic model of a family office emphasises preserving not only financial capital but also the family’s other important qualitative forms of capital - human, intellectual, social and spiritual. Scott Peppet explained the idea best, describing that… “Generation to generation, the best financial and legal advice will not save a family from the erosion of character, purpose, and cohesion that time is likely to inflict. A family must understand that its greatest asset is its family members, not its financial balance sheet, no matter how many zeroes that balance sheet might display. Likewise, a family office must understand that its ultimate purpose is to invest in and steward the human beings in its care, not the dollars in its coffers.” Along with this, he proposes a ratio of time spent between the activities of money (M), legal matters (L) family (F). Anecdotally, most family offices spend 60% of their time managing money, 30% mitigating legal, regulatory and tax risks, and the remaining 10% on family well-being. If the family office’s raison d'etre is to serve the family, this ratio poses a problem. Unrealistically, such family offices seem to be attempting “to preserve and protect the family’s well-being over multiple generations while simultaneously radically underinvesting in it.” To be a family-focused office, resources must be allocated in a way that aligns with its purpose, strategy, and priorities. A balance of attention to the family’s financial and non-financial capital is necessary. This re-calibrates what is important for the family office and reorients it towards a longer-term perspective. By embracing a holistic approach, away from the 60/30/10 MLF ratio, family offices can truly fulfil their purpose of serving the family's long-term well-being and transmitting legacy across generations. Family offices control trillions but enjoy the bare minimum regulatory oversight. "The Family Office Rule" under the 2010 Dodd-Frank Act means that by only serving "family clients", family offices avoid the deep scrutiny by the SEC. The key criteria to qualify for the Family Office Rule: Exclusively serve "family clients" - Family offices must only provide services to family members, key employees, and certain trusts to qualify for the exclusion Owned and controlled by family members - Family offices must be owned and controlled by family members, ensuring that decision-making is kept within the family No public investment adviser representation - Family offices cannot present themselves to the public as investment advisers, which includes offering investment advice to non-family clients No investment "advice" to non-family clients - Family offices cannot provide investment advice to anyone outside the defined "family clients," including co-investors from other family offices Club investing restrictions - Engaging in "club investing," where multiple families co-invest in assets, could trigger SEC registration if considered providing investment advice to non-family clients Sharing employees risks - Sharing employees between multiple family offices could result in providing investment advice and potentially cross into the "multi-family office" category, requiring SEC registration Interested to see what 2025 will hold for family offices and regulation. #familyoffice #wealthmanagement #UHNWI

A FAMILY OFFICE IS NOT ENOUGH TO PRESERVE FAMILY WEALTH ✨ A family office must integrate into a broader wealth management framework to effectively promote wealth growth, preservation, and transfer to future generations. ❗ A siloed approach risks falling short of the desired results. Family governance, ownership structuring, and estate planning are essential building blocks within this comprehensive framework, with the family office acting as an enabler. ▶️ FAMILY GOVERNANCE is based on the family's narrative and values, providing a communication and decision-making framework with processes and governance bodies such as family assemblies and councils. ▶️ OWNERSHIP STRUCTURING determines how the family owns its wealth in the long run. Trusts and foundations assist in protecting wealth and ensuring a smooth transfer to future generations. ▶️ ESTATE PLANNING outlines how family members will benefit from the wealth under specific conditions and what's the family's mission in preserving its wealth. The family office ensures coordination among these building blocks within the overall wealth management architecture. An emotional connection between these factors is vital for preserving family wealth. 🎯 The family office delivers the best results when fully integrated, not isolated. #centrolaw #FamilyOffices #FamilyOffice #WealthManagement #EstatePlanning Photo by Francesco Zivoli on Unsplash

If your family office is only managing your finances for higher returns, you have gotten it wrong! To many, family office appears as a back side functioning entity doing the operational work relating to finance. However, the prime thing that a family office delivers is the cohesiveness of the identity of the family business, growing the financial capital whilst increasing the trust with all stakeholders. In addition, a family office further strengthens a credible reputation which can help differentiate your family business in a crowded marketplace and build partnerships across generations. Not all family offices are the same. Family offices are designed as per the family’s DNA, constitution, and governance. It can deliver everything from a simplistic personal wealth planning to complex collective investment and asset management. The diagram below shows that the family business who is the client family sits at the heart of the Family Office. The role of the family office is to act as a shield between family and external institutions, bodies and stakeholders to guide, protect and grow the wealth, reputation, impact and value of the family. #familyoffice #familybusiness

The Governance Guardrails of Successful Family Offices One of the most critical, yet overlooked, factors that make or break family offices is having a robust governance framework from the start. As this short video explains, effective governance allows you to: 1. Proactively prevent issues before they become relationship-fracturing problems. 2. Clearly communicate the family's values, mission, and long-term vision. 3. Keep members informed on strategic direction, progress, and decisions. 4. Establish structured channels for family members to voice ideas and concerns. 5. Bring the family together to make key decisions in an organized manner. Too many family offices start with just informal ad-hoc governance. But as they grow, that quickly becomes unsustainable chaos. The solution? Implementing foundational elements like: • A Family Constitution - Codifying principles, policies and procedures. The north star. • A Family Council - The core decision-making body representing key branches. • A Family Assembly - A forum for the extended family to receive updates and provide input. • Advisory Boards - Panels of trusted advisors and subject matter experts. • Other Committees - Focused on key areas like investments, philanthropy, etc. With a solid governance blueprint, you ensure alignment. Without it, you're flying blind towards the next emergency! Of course, governance takes work. But like anything priceless, the upfront investment will prevent exponentially more costly consequences down the road. What has your experience been with family office governance - whether having it or lacking it? We'd love to hear your perspectives. Let's discuss in the comments! #familyoffices #familybusiness #familywealth
