Corporate Sustainability Due Diligence Directive (#CSDDD): The CSDDD is a legislative initiative by the European Union Council. Its primary goal is to enhance responsible business conduct by imposing due diligence obligations on large companies. Key aspects of the CSDDD include: · Scope: It applies to both large EU companies and non-EU companies active in the EU. · Adverse Impacts: The directive focuses on identifying and addressing actual and potential adverse impacts on human rights and the environment. · Value Chain: Companies must assess impacts related to their own operations, those of their subsidiaries, and those carried out by their business partners. · Penalties and Civil Liability: The directive establishes rules for penalties and civil liability in case of violations. · Paris Agreement Alignment: Companies are required to adopt a plan ensuring their business model and strategy align with the Paris Agreement goals. · Transition to Green Economy: The CSDDD contributes to the EU’s transition toward a more climate-neutral and green economy as outlined in the European Green Deal and the UN Sustainable Development Goals. 📢 BREAKING NEWS 📢 The EU Parliament has just passed the Corporate Sustainability Due Diligence Directive (#CSDDD)! This landmark legislation will have significant implications for companies across the EU and their global value chains. Under the CSDDD, in-scope companies will be required to conduct thorough due diligence on their actual and potential human rights and environmental impacts throughout their value chains. This means identifying, preventing, and mitigating adverse impacts, ensuring accountability and access to remedy, and promoting sustainable business practices. One key aspect to note is that these obligations won't just stop with large corporations. In order to comply with the directive, in-scope companies will cascade due diligence and data collection obligations down the value chain to all business partners and suppliers, regardless of their size. This means being prepared to provide detailed information about their own operations, practices, and impacts, along with those of their suppliers. It is no exaggeration to say that millions of MSMEs around the world, including artisans and smallholder farmers, will have to generate and report data they do not have at present. Equiception’s Due Diligence Platform and Human Rights and Environmental Due Diligence Assessments are designed to help organisations map all business partners and suppliers and provide actionable insights into risk management across their value chains while building partner capacity. 📢 🔔 Big News! Today, on 24 April 2024, the EU Parliament endorsed the Council’s version of the Corporate Sustainability Due Diligence Directive (CSDDD). ⏮ Rewinding a bit, on 14 December 2023, the Parliament and the Council reached a political agreement on the CSDDD proposal. They initially set the scope of the proposed Directive to capture companies that have more than 500 employees and a net worldwide turnover of over €150 million. ⏭ Fast forward to 28th February 2024, the Council did not endorse the political agreement of 14 December 2023. However, on 15 March 2024, the Council introduced amendments to the provisionally agreed text. These amendments significantly watered down the scope of the agreed compromise of 14 December. The Council revised the scope to cover companies with over 1000 employees and a net 450-million-euro turnover. 💡 The CSDDD represents a transformative step for sustainable enterprise in the EU. Notably, entities within its scope are required to engage in extensive due diligence to mitigate negative impacts on human rights and the environment. This extends to their own activities, those of their subsidiaries, and their entire upstream and downstream supply and production chain. This Directive will bring about challenges and opportunities for business partners of in-scope companies. 📞 📧 We invite you to reach out to us if you have any questions or need assistance navigating these changes.
