[previous post in portuguese] LETS TALK ABOUT THE CUSTOMS SYSTEM I often say that the customs system is a kind of dark matter in the international trade and (inter)national security systems. The customs system is one of the central tools for the countries to regulate and structure trade flows between them. The origin and socio-historical reasons for the centrality of the customs system in the organization of international trade may be the subject of a further discussion. The angle I’d like to bring up here is the need to get to actually know our customs system, understanding it not as an obstacle to a country's relations with the world, but as an enabler for this to happen without compromising its political and economical unity and integrity. But what does actually mean to know a customs system? Among many other possible approaches, there is one that seeks to inform the maturity of these systems in their particular realities among the countries in the world. It was in this spirit that the Customs Cooperation Council (CCC) emerged in the 1950s, and four decades later, in the 1990s, it gave rise to the World Customs Organization (WCO), a kind of specialized version of the much better known World Trade Organization (WTO). Since the 1990s, the WCO has been able to introduce important tools into international trade practices and standards to link the customs systems of a wide range of countries around the world. These include the Harmonized System (HS) and the Customs Valuation system, as well as other procedural and systemic standards. One challenge that any organization of this nature faces is the dissemination of its standards. And disseminating referring not only to spreading knowledge about them, but also to actually adopting them as a way of carrying out the function for which the specific system was created - in the case of the customs system, controlling the entry and exit of goods in and from countries, and the circulation of goods internationally, regionally and globally. To this end, a system has been developed to measure the maturity of the world's customs systems, the so-called customs Performance Measurement Mechanism (PMM), as an essential part of the customs performance measurement systems. The function of a country's customs performance measurement system is to make it known under the aspects that constitute, in general terms, its effectiveness (the actual effect its activities produces) and its efficiency (the relation between the volume of resources employed and its effectiveness, i.e. the effects generated by their use). There are efforts and interest in implementing a system like this in Brazil, but both the efforts and the interest, due to the scarcity of other knowledge about the very function and raison d'être of the customs system itself, are not enough to the importance that this matter has for Brazilian national life.

Egyptian Customs Authority Standardizes Ship Bunkering Procedures Shipping Arabia, August 16, 2024 — The Egyptian Customs Authority has released a set of comprehensive guidelines under Procedures Circular No. 8 of 2024, aimed at standardizing and regulating ship bunkering operations across all Egyptian ports and airports. These guidelines are designed to align with international standards, such as the Kyoto Convention, and national regulations, including Customs Law No. 207 of 2020 and Import and Export Law No. 118 of 1975. The new protocols introduce unified customs procedures for provisioning ships, aircraft, and trains with necessary operational supplies like fuel and lubricants, excluding spare parts. This standardization ensures consistent treatment of goods consumed by passengers and crew or sold during voyages. Detailed provisions for bunkering operations specify the process for both Egyptian and foreign vessels using local and foreign goods. These operations are exempt from duties and taxes under conditions validated by customs, considering the number of passengers, crew, and voyage duration. Bunkering requests must now include comprehensive documentation, such as the vessel's name, docking details, shipping agency, and an inventory list. The Customs Authority is tasked with inspecting and verifying these details to ensure compliance before granting approval. The guidelines also cover the temporary release of equipment for repair and maintenance, requiring customs guarantees to cover potential duties. The return of repaired items is closely monitored, updating customs records to ensure accountability. Additional procedures address container repairs, ship maintenance, and waste disposal, necessitating authorization from the Port Authority and detailed submissions to Customs for any materials or waste management. Special procedures are also outlined for handling animal feed on ships carrying live animals and managing surplus supplies returned post-delivery. These measures include stringent checks to prevent unauthorized exports without proper duty payments. Through these guidelines, the Customs Authority reaffirms its commitment to enhancing operational efficiency and supervision, ensuring that all bunkering activities comply with the latest legal and regulatory standards. If you are sending or receiving international mail, you should be aware of the customs regulations and procedures that apply to your country and the destination country. Customs is the authority that regulates the movement of goods across borders, and it may impose duties, taxes, restrictions or prohibitions on certain items. Here are some tips to help you avoid delays or problems with your international mail: 🌍 🛩 🚚 ✅ Check the list of prohibited and restricted items for both countries before you send or order anything. Some common items that may be subject to customs controls are food, plants, animals, medicines, weapons, alcohol, tobacco, and currency. ✅ Fill out the customs declaration form accurately and completely. You will need to provide information such as the sender's and recipient's names and addresses, the description and value of the contents, the purpose of the shipment, and the harmonised system (HS) code if applicable. ✅ Attach the customs declaration form securely to the outside of your package, along with any other required documents such as invoices, certificates, or licenses. Make sure the information is clear and legible, and use English or an official language of the destination country. ✅ Pack your items securely and label them clearly. Use sturdy boxes or envelopes, cushion fragile items with bubble wrap or newspaper, seal the package with strong tape, and write the address in capital letters. Include a return address and a phone number or email address for both the sender and the recipient. ✅ Track your package online or contact Reliance - Global Mail & Parcels for updates. You can use the tracking number provided by your postal service to check the status of your package on their website or app. Keep in mind that customs clearance may take some time depending on the volume of traffic and the type of items. 🛃 Latest Customs News We have collected for you the main news of the last days concerning customs clearance. ✅ Draft amendments to the 18th Annex of PP RF 353 Until October 14, there will be a discussion of the draft amendments to the 18th Annex of the Decree of the Government of the Russian Federation of March 12, 2022 № 353. It is this Annex that establishes simplified declaration of imported goods. It is assumed that its procedure will be changed, namely, a list of specific products with the TN VED code and country of origin will be introduced, in respect of which the very simplified rules will apply. Now there is just a list of exceptions, there are no general rules under which products fall or do not fall. ✅ Simplification of customs control of containers in the EAEU The Eurasian Commission has made the following decisions. 1. When goods are transported by rail in containers, it is the container that must be the means of transportation for the purposes of customs control. For the purposes of customs control, it does not matter which platform is under the container. Accordingly, the issues of reloading from one platform to another, if, for example, in the course of transportation there is a technical failure, are significantly simplified. 2. For transit shipments through the territory of the Eurasian Union, it is not necessary to indicate the invoice value of goods being transported. In the future, this may have a significant impact on issues relating to the introduction of electronic document management. In practice, a legal regulation arises where it may not be necessary to attach an invoice to a transit declaration. ✅ The materials of customs inspections are to be allowed to be copied The persons being checked want to guarantee the right to familiarize themselves with and copy the materials of customs inspections. Such a draft law of the Cabinet of Ministers was recommended for adoption in the second reading at the meeting of the State Duma Committee on Budget and Taxes. The document obliges the customs authority to provide the audited person or his representative the opportunity to familiarize with the materials of the customs audit no later than five working days from the date of submission of the relevant application. According to the initiative, familiarization involves visual inspection of the document, making extracts from it and copying (photographing).
