SAVE THE DATE: APIEx Symposium 2024 - A Focus on Valuation in Dispute Contexts WHEN: 28 Nov 2024, 1.00pm - 6.00pm SGT WHERE: NTUC Centre, Room 701, Level 7, One Marina Boulevard, Singapore 018989 As the complexity of disputes has increased, the rigour and sophistication with which Courts and Tribunals assess valuations has also become more intense. Asia Pacific Institute of Experts (APIEx) is delighted to host a half day Symposium dedicated to valuations and supported by the IVAS - Institute of Valuers and Appraisers, Singapore (IVAS), the Intellectual Property Office of Singapore (IPOS) and the International Valuation Standards Council (IVSC). The first session will look at the use of valuation standards in the context of disputes. There will be a presentation by the IVSC and the panel will provide insights to the potential benefits of applying International Valuation Standards. In the second session, our panel of practitioners will take an in-depth analysis of the information that could and should be used in a valuation. Following on from the APIEx Seminar “Ex Ante & Ex Post Assessments of Damages - Crystal Balls Vs. Rearview Mirrors? (19 Sept 2024)”, the panel will focus on the use of information after the valuation date and the circumstances where this may be appropriate. The final panel will discuss the valuation of intellectual property and explore the unique challenges and strategies to deploy in disputes, including the appropriate measure of damages where the terms of the IP protection has been breached and the guidelines which can be followed. 🌍 Advancing IP Dispute Resolution Through Mediation I recently had the privilege of speaking at the EUIPO - European Union Intellectual Property Office webinar, “Effective Resolution of IP Disputes: The Importance of Mediation.” It was a fantastic opportunity to discuss the transformative role of mediation with our knowledgeable moderator, Javier Soriano and my fellow panelist,Cinzia Negro. My thanks to them both for an engaging and insightful session. As lawyers, we are often at the forefront of resolving disputes, and mediation offers a powerful tool that I believe more practitioners should consider. Here are key points from our session: • Time and Cost Efficiency: Mediation can save both time and expenses compared to traditional litigation. With the EUIPO Mediation Centre, parties have access to structured, efficient processes. • Maintaining Relationships: Mediation supports a collaborative approach, which can be essential for clients who value their business relationships. • Tailored Solutions and Confidentiality: Mediation’s flexibility makes it a suitable choice for the unique demands of IP disputes, ensuring confidential, customized resolutions. Essential Insights for Lawyers • Client Preparation: Lawyers must be prepared to guide their clients and themselves through the mediation process, sometimes adjusting their expectations or initial demands to find common ground. Being ready to act quickly—or step back as needed—can be key to reaching a resolution. • Commitment to Mediation: A lawyer’s commitment to resolving the case through mediation is crucial. When lawyers demonstrate dedication to the process, clients are more likely to take mediation seriously. • Creating a Confident Environment: Confidence in the case and in the potential for settlement can set a relaxed tone, minimizing prolonged legal arguments and keeping discussions productive. • Engaging Key Decision Makers: Involving the CEO or key decision-maker early can accelerate finding business-focused solutions, allowing the lawyer to craft an agreement that meets the client’s core objectives efficiently. With IP laws and market demands rapidly evolving, leveraging ADR options like mediation is more relevant than ever. I encourage my colleagues across Europe to explore the resources at the EUIPO Mediation Centre and consider how mediation could benefit your clients. Albert Knigge, Rosalie Becker and Luce Mulder investigated the current and future class action developments in Belgium in collaboration with Sarah van den Brande, Jean Pierre Kesteloot and Olivier Vanden Berghe from Liedekerke .   In Belgium, the Representative Actions Directive (RAD) is transposed by the New Collective Redress Act, published on 31 May 2024. This Act applies to class actions brought from 10 June 2024 and broadens the scope of the existing class action regime. Class actions can be brought by qualified entities, including ad hoc entities, in the interests of consumers and SMEs. Class members must, in general, opt in within four months after the ruling of redress. Third party litigation funding, while allowed, remains unattractive due to the rules on legal costs and the delayed opt-in mechanism. Given these factors, a surge in popularity for class actions in Belgium is not expected.   In October, we are holding an interactive seminar where the main results of this research will be presented.
