There are special mechanisms within US State Department policies that give Israel an out even if its use of American weapons violates US or International Law. Something any thinking observer of the Middle East probably deduced decades ago. There are three main mechanisms that exist for Israel and no other country: 1) a formal meeting has to take place of a special committee for violations involving Israel; 2) Israel has 90 days to respond (which allows for long delays in wartime); and, 3) Israel's legal system is categorized as robust, so it is allowed to legally deal with violations involving the country.

This paper provides a critical examination of the EU's shift towards using criminal law to enforce sanctions against Russia and Belarus following the 2022 invasion of Ukraine. It delves into the implications of harmonizing criminal definitions and penalties across EU Member States, raising important questions about the proportionality - and appropriateness - of such measures. The Illegitimate Court Counteraction Bill, which passed the House of Representatives in June 2024, will be considered by the Senate foreign relations committee. The committee was to consider the bill this week, but the hearing was postponed. A new date is yet to be set, reports suggest it will be no earlier than November 2024. The Bill would impose sanctions on “foreign persons” of the ICC “engaged in any effort to investigate, arrest, detain or prosecute any protected person of the US and its allies, and for other purposes”. This includes civil servants their parents and siblings. The District Court of Rotterdam has permitted a defendant (charged with breaching Russia sanctions by exporting computers to Russia via third countries) to continue trading his company’s stock pending his criminal trial.
