Check out our update on the District Court decision regarding the prosecution, and now conviction of the former Port of Auckland CEO for breaches of due diligence duties as an officer under the Health and Safety at Work Act 2015. This is the first of its kind for an officer of a large complex company, but the case did have some unique factors. At a District Court hearing on 22 August 2024, a strata company and owners corporation were both found guilty under the Work Health and Safety Act NSW 2011 for failing to urgently repair a gate. The strata firm was fined $150,000 plus costs, while the owners corporation was fined $225,000 plus costs. The worker's employer was also found guilty of "failing to comply with its duty to ensure, so far as reasonably practicable, the health and safety of its workers," and was fined $375,000 plus costs. In total, $750,000 in fines were issued by the court in relation to the incident. Today, leaders in the multi-family industry gathered at the State Capitol to meet with Senator Eric Lucero to discuss important legislation drafted by Andrew Perry the “Frontline Property Management Staff Protection Act.” This Bill aims to enhance public safety by increasing the penalties for assaults against frontline property management staff and housing services workers. These professionals perform essential duties in support of their residents, and it's crucial to ensure their safety and well-being while they carry out their responsibilities. Under this proposed Act, any person who assaults a frontline property management staff member while they are performing their official duties would face felony charges, with penalties equivalent to those for assaulting peace officers or medical personnel. The urgency of this proposed bill is underscored by recent tragic events where in Minneapolis, a man attempted murder and assaulted his property manager with an ax after receiving a non-renewal notice, and in February, a resident of a Brooklyn Park senior housing community shot and killed the assistant manager. ACMO: The Joint Safety and Security Committee, comprised of ACMO, CCI-T and CAI-C continues to identify ways to improve safety and security in condominiums. In June, the committee sent a letter to the Minister of Justice and Attorney General Canada and copied relevant provincial ministers proposing a series of potential changes to the Criminal Code of Canada. The letter requests tougher sentencing laws for individuals who commit violent crime, or attempt to commit violent crime against condominium directors, officers, managers and related support staff. This is the fourth letter in a series that identifies areas of legislation that can better protect condominium managers.
