An Overview of Iran's New Industrial Property Protection Act: Changes, Innovations, and Key Takeaways Introduction The new Industrial Property Protection Act of Iran, aimed at improving and developing the intellectual property system, was finally enacted this summer after much debate. This law encompasses new principles and regulations designed to protect and regulate industrial property rights, including patents, trademarks, industrial designs, and other forms of intellectual property. Key Changes in the New Act Patents: Extended protection period from 20 to 25 years, simplified registration, public info systems, alignment with TRIPS, special provisions for biotech, increased penalties. Industrial Designs: Extended protection period, comprehensive definition, streamlined registration, higher penalties, faster dispute resolution. Your company operates in the manufacturing industry and on the basis of its general terms and conditions it purchases raw materials and semi-finished goods from a number of suppliers. Italian law provides for a particularity in these cases regarding the approval of the arbitration clause. Indeed, your suppliers must sign the contract not once, but twice. The second signature is precisely to approve the arbitration clause. The Italian Supreme Court will shortly deal with this topic, indicating whether this rule also applies to international trade contracts (which some lower Courts exclude). In the meantime, the Italian Courts continue their work of slowly eroding this limitation. For example, they hold that an arbitration clause without the second signature is not enforceable, but that the relevant unenforceability can be claimed only by the party that should have signed twice (i.e., the party that accepted the general terms and conditions of the other). In this sense, a recent decision of the Court of Appeal of Naples (No. 5258 of 13 December 2023), which our Roberto Oliva, FCIArb has just published on Arbitrato in Italia (link in the first comment). The article, recently published on the Chambers and Partners Global Guide website, focuses on the new Made in Italy law, which makes intellectual property one of the pillars of the new strategy, with some specific provisions worthy of analysis. Together with the protection of geographical indications, intellectual property can play an active role in the development of Made in Italy.
