According to Hukumonline, a senior lawyer finds himself at the center of a contentious legal battle stemming from his efforts to enforce an International Centre for Dispute Resolution (ICDR) arbitration award. The situation escalated dramatically in 2023 when authorities named him as a suspect under Articles 220 and 317 of Indonesia's Criminal Code. The charges allege he filed false and defamatory complaints. This unprecedented move against a practicing attorney raising red flags about the potential criminalization of legitimate advocacy work. 🤔 What happens if a contract entered into in 1878 between the Sultan of Sulu and two European explorers gives rise to a dispute between the heirs of the Sultan and Malaysia more than a century later (2013) ❓ 🧐 Is the #arbitrationclause of the contract providing that any dispute would be referred to the British Consul in Brunei applicable ❓ ❌ No, according to the #courdecassation in a judgment rendered on the 6th November (n°23-17615), which upheld a previous judgment rendered by the Court of appeal of Paris, refusing enforcement in France of the award previously rendered between the parties in Spain. 👨⚖️ The judges approved the court of appeal of Paris which had held that the circumstances surrounding the drafting and signing of the #arbitrationclause, together with the drafting itself, revealed that the parties had agreed to give priority to a specific type of arbitrator i.e. the Consul over the intent to refer any dispute to arbitration. ⚖ The #arbitrationclause was therefore inapplicable as obsolete since the position of British Consul in Brunei did not exist any more. ⚠ Under French law, there is a limited number of reasons that can lead to the annullment of an arbitral award rendered abroad (see article 1520 of the #civilprocedurecode), the first of them being that the arbitral tribunal lacked competence. Hence the vivid discussions in this case about the #arbitrationclause still being applicable or not. 👉 This decision is part of the judicial saga often designated as the "Sultan of Sulu" case, where history mingles with points of law in a multijurisdictional environment : besides the French judgments, awards and decisions have been rendered in Spain and Malaysia. A must read for law&history fans ❗ ⌛ This case required some specific historical digging but raising the inapplicability of an #arbitrationclause is not always that fascinating and can be limited to searching the right T&Cs applicable at the time of the contract. 🚢 See e.g. in the maritime judicial saga of the "Estonia" (Cass. 1re civ., 27 avr. 2004, n° 01-13.831) where the #arbitrationclause contained in the 1990 T&Cs of the #classificationsociety was held inapplicable as the vessel was certified in 1980 and the T&Cs applicable at that time did not contain an #arbitrationclause but a #jurisdictionclause.
