A team of Fox Rothschild Labor & Employment and Appellate practice attorneys contributed an Amicus brief to a unanimous Supreme Court win, establishing that employers need only prove an exception to the Fair Labor Standards Act by a preponderance of the evidence. The Fifth Circuit’s August 2023 decision in Hamilton vs. City of Dallas may now pave the way for litigation challenging common aspects of employers’ diversity, equity, and inclusion initiatives.
