2. Ownership 2.1 Are there legal restrictions on ownership of real estate by particular classes of persons (e.g. non-resident persons)? Yes, Section 43 of the 1999 Constitution provides that every citizen of Nigeria shall have the right to acquire and own immovable property anywhere in Nigeria. Section 1 of the Land Use Act, 2004 vests all real estate in the territory of each state in Nigeria in the governor with a mandate to act as trustee of the real estate and administer the same for the use and common benefit of all Nigerians. Both seek to grant real estate rights to citizens while excluding foreigners. Non-Nigerians/Foreigners registered entities may, however, own real estate through corporate entities registered in Nigeria. The National Council of States by Section 46(a) of the Land Use Act also regulates the transfer of any interest in land to non-Nigerians.
