A case study from UK: European Community Association Agreement (ECAA) Administrative Review "A Turkish Applicant submitted an application for Entry Clearance as a Turkish Business Person under the ECAA route. His application was refused by the Home Office. Following this refusal, the Applicant submitted an Administrative Review (AR) application to the Home Office. This was also refused and the reasons for the refusal were set out in a decision letter. The applicant then approached our firm to see if we could offer any assistance. Our experienced team of immigration lawyers reviewed the papers and decision letter. It was our opinion that the client’s application was not fully considered and the Home Office’s original decision was flawed. We proceeded to draft substantive submissions setting out our position. Our representations were successful in persuading the Home Office to review and ultimately withdraw their decision. This outcome saved the client significant time and costs." Building a strong, diverse workforce is crucial for business success. In today's competitive landscape, attracting talent with niche skills or international experience can give your business a distinct edge. This is where migrant workers can be a valuable asset. However, the UK's immigration system can be complex and failing to ensure a migrant worker holds the correct visa can result in significant fines for an employer of up to £60,000 per worker. This hefty financial penalty, coupled with potential reputational damage, underscores the importance of legal compliance. In some circumstances, you can also face criminal sanctions. This is why expert legal advice is important. An employer who wishes to engage a migrant worker will likely need to obtain a Sponsor Licence as a means to legally employing that individual. The individual will also need to secure a visa to work in the UK and this will depend on their personal circumstances and the circumstances of the role they are required to perform. Obtaining a Sponsor Licence takes several weeks, so starting the application process sooner rather than later is crucial to avoid delays in filling critical roles. There are some categories of work visa (such as graduate visas) that allow an individual to work in the UK without their employer first obtaining a Sponsor Licence but these routes tend to be limited to just a few years of employment. Whereas this can be a great way to bring a migrant worker into an organisation to trial them without incurring the cost of obtaining a Sponsor Licence, it is important to consider how they can be retained if the trial goes well. Due to the length of time it takes to secure a Sponsor Licence, it is best not to leave the decision too late.  Doing so may result in their permission to remain expiring before the employer can obtain a Sponsor Licence and/or apply for a visa to enable them to continue working for the company lawfully. It is worth bearing in mind that there is no grace period allowed when it comes to permitting an individual to work illegally. Allowing an individual to continue to work unlawfully, even for just one day, could still attract a fine.
