Valuation of Cryptocurrencies: Cryptocurrencies’ volatile nature and lack of a single objective market value complicate their valuation. Different exchanges may show different prices for the same asset. 2. Choosing a Reference Date: The breach date is typically used for valuing damages, but given cryptocurrencies’ volatility, choosing this date can result in significant disparities in assessed value. The court had to decide whether to use the breach date or another date within a reasonable period. On point 1, in the absence of a single source of truth, perhaps someday one could just use the average spot price of the top five crypto exchanges (within said period given that their rankings might change too)? Market influence and speculative value is tricky: Despite being technically worthless post-breach, the market conferred residual value on the wrapped assets due to speculative trading. Given that the market is irrational, and that judicial reasoning is logical, putting two together is akin to asking what happens when an unstoppable force meets an immovable object?
