The emphasis on 𝐩𝐫𝐞-𝐥𝐢𝐭𝐢𝐠𝐚𝐭𝐢𝐨𝐧 𝐦𝐞𝐝𝐢𝐚𝐭𝐢𝐨𝐧, as outlined in 𝐒𝐞𝐜𝐭𝐢𝐨𝐧 𝟓, highlights the shift toward amicable and efficient dispute resolution before stepping into the threshold of courtrooms. The Act also provides a robust regulatory framework through the 𝐌𝐞𝐝𝐢𝐚𝐭𝐢𝐨𝐧 𝐂𝐨𝐮𝐧𝐜𝐢𝐥 𝐨𝐟 𝐈𝐧𝐝𝐢𝐚, responsible for setting standards, promoting training, and facilitating both domestic and international mediation. This institutional support marks a crucial step in aligning India's mediation practices with global standards. Another key aspect discussed was 𝐎𝐧𝐥𝐢𝐧𝐞 𝐌𝐞𝐝𝐢𝐚𝐭𝐢𝐨𝐧 𝐮𝐧𝐝𝐞𝐫 𝐒𝐞𝐜𝐭𝐢𝐨𝐧 𝟑𝟎, which embraces technology to make dispute resolution more accessible and efficient, including through platforms such as secure chat rooms and audio-video conferencing. These approaches will not only reduce judicial burdens but also empowers parties to reach mutually agreeable solutions, fostering lasting harmony. I am excited about the opportunities this legislation opens up for professionals in mediation, from career flexibility to serving as corporate mediators. Mediation Tip Monday - Your job is NOT to be liked. (the value of this may vary depending on your experience level) I make a lot of statements about being amicable, only fighting when absolutely necessary, etc. But sometimes I see that taken too far. When attorneys, parties, and even mediators care a lot about how the various people feel about them. There is emotion in any negotiations. Feelings are important in reaching a compromise. But an attorney's job is to get it right for their client. Any deviation from that creates a potential barrier between client and attorney - one that the mediator often has to step in to bridge the gap. If you are regularly professional, kind, decent, and fair - you will maintain that reputation regardless of individual moments of advocacy in mediation or otherwise. You will end up being liked because you are ethical and skilled in representing your client -not because you are 'nice' or 'met them in the middle'. Get it 'RIGHT' for your client without being a jerk and the reputation will follow. And so will successful mediations. #tipsandtricks #mediationskills #adr #professionaldevelopment #professionalism

Misconceptions About Mediators A conversation with someone hiring a mediator for their workplace got me thinking about the common misconceptions surrounding what mediators do. They said, "I’m bringing in a mediator and have told the two people arguing that I’ll be following the mediator’s recommendation." I had to clarify that this isn't what mediation is about. A mediator's role is to bring participants together and facilitate a process where they find a solution, not to impose one. As our conversation continued, it became clear that they viewed mediation as a "head-knocking service." But that’s not why I became a mediator. Mediation isn’t about pressuring people into agreements. It’s about creating a space where fear, whether of conflict or the process itself, is removed. A skilled mediator provides a safe, open, and trusting environment where participants can explore alternative solutions together. If that’s the kind of service you need, I’d be happy to help.
