The USCIS has recently clarified Cap-Gap extension regulations, a critical provision for F-1 students moving to H-1B status in the U.S. This Cap-Gap extension acts as a bridge between F-1 OPT expiration and the H-1B start date (typically October 1), allowing eligible students to maintain legal status and work authorization during H-1B processing. Important points to be aware of: 1. Cap-subject H-1B petitions are filed for F-1 students requesting status change. 2. Extends from F-1/OPT expiration to October 1 H-1B commencement 3. No separate application or new EAD needed. 4. Ends if H-1B petition is denied, withdrawn, revoked, or not selected. 5. 60-day grace period applies if extension terminates, except for status violations. Maintain close communication with your petitioning employer and regularly check your petition status. This provision is crucial for F-1 students transitioning to H-1B, ensuring seamless continuation of their U.S. residency and often their employment. Cap-gap reminders for students on F-1 F-1 students who are not eligible for a cap-gap extension and facing authorized stay expiration before Oct. 1, 2024 must exit the US. These students may have to leave the United States to avoid potential complications. They can re-enter by securing an H-1B visa at a consular post abroad, if applicable, and seek to re-enter into the United States pursuant to H-1B status based on the approved H-1B petition and visa. The cap-gap rule pertains to cap-subject H-1B petition beneficiaries (counted towards H-1B lottery for Fiscal Year 2025 / in the year 2024), not cap-exempt ones.
