Prof. Dr. Hon. Sifuna has made a groundbreaking ruling in Justus Ndungu v R, stating that both life and death sentences are unconstitutional. The severity and permanence of these sentences are two sides of the same coin, making them archaic, unreasonable, and absurd, and violating the right to human dignity. The ruling emphasizes the importance of certainty in sentencing, including the period and commencement date. As per section 108 of the Indian Evidence Act, 1872, if a person is missing for SEVEN years and proved that he has not been heard of for 7 years by those who would naturally have heard of him if he had been alive, he would be legally considered dead and the burden of proving that he is alive is shifted to the person who claims he is alive. In a legal parlance it is called Civil Death. This assumes real significance in cases where a person with lot of assets goes missing, as it will be difficult for the legal heirs to legally claim the property of the missing person during the period of 7 years. Next time when you see the poster or advertisement with the caption “Missing” of a Person, you may understand there is not just a LOVE but also a LAW behind it.
