An interesting development surrounding the common baitfish known as the smelt that in spite of massive water theft from farmers and the citizens in California, has still managed to almost die out without abnormal supportive activities from environmentalists and the waterboard, among others. The real culprit threatening fish is partially untreated sewage dumped into the Delta and into the bay because of billions of dollars of deferred upgrades to wastewater plants. California agriculture should not be sacrificed on the altar of mismanagement and Eco-stupidity with continued water thefts, and ‘sustainable’ water rationing when we already have abundant supplies of water, if not horribly mismanaged, putting a baitfish before the public good. Time to return all of the water taken from citizens and farmers with interest in the amounts of millions of acre feet per year of the 19,000,000 acre feet on average that has been dumped into the ocean and done little if anything for the fish. Let’s just think of it as a horribly misguided and failed experiment shall we? One thing this water wasting has done is drive businesses out of state, and food inflation through the roof, as more and more farms had water unconstitutionally taken. Billions of dollars in damages annually for the past many years have been inflicted upon the victims of the smelt and ESA driven anti farmer water wars. Water grabbers beware, participation in unconstitutional taking of water and water rights from farmers going back decades can have significant personal financial liabilities because violating the constitutional rights of people, with a SCOTUS ruling against these practices/mandates, will strip you of any qualified immunity you thought you had, and make you personally financially liable for billions of dollars in damages to thousands of farmers. In my opinion, this would apply to any past activities as well as ongoing SGMA related activities, which are in my opinion, on their face… Unconstitutional. Today at its 4Q Business Meeting, the DRBC approved two resolutions that incl. special permits to coordinate the operation of regional reservoirs, out-of-Basin water diversions and Delaware River flow objectives, *should* Basinwide drought conditions be reached. "The DRBC is well-positioned to manage water supplies during drought conditions by coordinating water releases from federal, state, municipal and hydropower reservoirs in three states, providing direct benefits to all Delaware River Basin Commission members and communities," said New York State Department of Environmental Conservation Interim Commissioner Sean Mahar. "The special permits approved today will set in motion management actions that will maintain access to clean water for the entire Basin, should conditions worsen."
