A federal court in Texas has found that the FTC lacked authority to ban non-compete agreements, but the court limited its preliminary injunction to the named plaintiffs. The Court’s decision not to apply the injunction nationwide prolongs the uncertainty for businesses, employees, and the FTC itself. In this Client Alert, Erika Todd and Ryan Rosenblatt discuss the decision and what comes next. To read the alert, click here: https://lnkd.in/ePHbntzQ #WhatsYourNext

This was a very surprising twist in the FTC non-compete litigation that we have been following closely. Erika Todd and I discuss in this alert how a federal court in Texas has found that the FTC lacked authority to ban non-compete agreements, but the court limited its preliminary injunction to the named plaintiffs. The Court’s decision not to apply the injunction nationwide prolongs the uncertainty for businesses, employees, and the FTC itself. My latest commentary on the twisting path of the many challenges to the FTC's non-compete ban. Just weeks after a federal court in Texas held that the FTC exceeded its authority in issuing a rule banning nearly all non-compete agreements (and, therefore, the plaintiffs challenging that rule were not bound by it), a federal court in Pennsylvania has reached the opposite conclusion. In this Client Alert, Erika Todd, Brandon Ross, and I discuss the decision made by this Pennsylvania federal court and what this means going forward. A federal court in Texas yesterday blocked the FTC’s Non-Compete Rule and set the rule aside. The FTC is thus prohibited from enforcing the rule on a nationwide basis and it will no longer go into effect on September 4, 2024 (unless an appellate court says otherwise). What can companies do to prepare for the FTC’s broad ban on noncompetes while challenges to the new rule play out in court? Rulings are expected in July 2024 in two of those cases, well before the rule takes effect in September.
