California workplace violence law In less than 3 months SB 553 will go into effect in California. Although the language is, at times, vague, the impetus of the legislation was the mass shooting at the VTA rail yard in San Jose, and mitigating active shooter attacks is a core element of the bill. One crucial step in a workplace violence program is threat management. For years, law enforcement has been telling people that if you “see something, say something”. The next crucial step is someone has to “do something” with the information. The OPS Plan for the President Trump rally in Butler, PA should be scrutinzed as part of any review of the events in PA. An Operational Risk Assessment/Plan is normally used to document special events and law enforcement planned actions in advance and is used as a guide to ensure important factors are considered including a pre-site assessment and tactical planning for the site. The Secret Service would have used an advance team for the site assessment and to secure the site in advance of the arrival of President Trump. This site assessment would have included any physical locations, any photographs of locations that presented a threat, a check for pre-booby trapped/explosive threat, intelligence related to event, and threats made prior to event. It would be interesting to see if the building the shooter was perched on was deemed a threat during the site assessment. - Operational Risk Assessment and Plan would cover: Any potential person identified as a threat - criminal history, drugs use, weapons, and violence assessment - The plan would normally specify - All individuals involved in the security operation: advance team; secret service detail, and local law enforcement responsibilities; special team instructions, additional equipment needed, and any special considerations. The plan would normally identify local telephone numbers and locations for police department, fire department, hospital. The plan would normally include the name of preparer, second level approval, and in many cases the plan will also be initialed by the Special Agent in Charge, Assistant Special Agent in Charge, and Resident Agent.
