💚 Today is Human Rights Day, 2024 💚 This year's theme, 'Our rights, our future, right now' is a timely reminder of how important it is for Aotearoa NZ's new Mental Health Bill to align with the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD). The previous Mental Health Bill makes no mention of the UNCRPD - our Changing Minds submission will include the importance of referencing the UNCRPD in the new Bill, to uphold the human rights of our Lived Experience community. At Changing Minds we see the new Bill as an opportunity to learn from more modern, human rights-based policy, upholding the human rights of Tāngata Mātau ā-wheako with more options for holistic care and peer support, supported decision-making, and the minimisation of compulsory treatment and coercion. The Joint Committee on Human Rights is undertaking scrutiny of the Mental Health Bill to assess its compatibility with international and domestic human rights standards. It is asking for views on the following (deadline 24 January): 1. The Bill will remove the power for autistic people and people with learning disabilities to be detained under section 3 of the Mental Health Act on the basis of their autism or learning disability. However, no equivalent changes are made for autistic people and people with learning disabilities under Part 3 of the Act (so-called ‘forensic’ patients). Does this differential treatment raise any concerns under Article 14 ECHR when read with Article 5 or Article 8 ECHR? 2. The Bill will allow conditions amounting to a deprivation of liberty to be applied as part of a conditional discharge (see Clause 33). a. Are there sufficient safeguards for the new deprivation of liberty conditions to be compatible with Article 5 ECHR? b. The Bill will allow these deprivation of liberty conditions to be applied retrospectively, meaning that a patient who is already conditionally discharged could be made subject to them. Does this raise any human rights concerns, particularly under Article 5 ECHR? 3. The Mental Health Act 1983 and the Mental Capacity Act 2005 can both be applicable to the detention and treatment of patients with mental health conditions. Does the interaction between the two Acts raise any human rights concerns? In particular, are there any concerns that the law is insufficiently clear to fulfil the “prescribed by law” criteria in Article 5 ECHR, or to raise discrimination concerns under Article 14 ECHR? 4. Other than the issues identified in the above questions, does the Bill raise any other issues under the ECHR or the Human Rights Act 1998? 5. The UK is a party to the UN Convention on the Rights of Persons with Disabilities. Does the Bill raise any concerns regarding the UK’s compliance with this convention? 6. The Bill has provisions which would apply to children as well as adults. The UK is a party to the UN Convention on the Rights of the Child. Does the Bill raise any concerns regarding the UK’s compliance with this convention?

The promise of the Americans with DIsabilities Act (ADA) to ensure access to mental healthcare deserves amplification. The DOJ’s investigation into Michigan looks at the enforcement of the ADA and its power to protect the rights of those with mental illness. This year, Co-Director's Kat Baulch and Jacque Lachmund are joining forces with Cameron Cliff from Capyble and Ben Bjarnesen BM CF from the LGBTQ Domestic Violence Awareness Foundation to explore how frontline services and educators can safely harness lived experiences to create meaningful change in responding to domestic and family violence (DFV) within the LGBTQ+ community. Central to our presentation is ‘See, Hear & Believe’, a free resource developed for frontline workers. This eLearning program amplifies the voices of LGBTQ+ victim-survivors through powerful video testimonials, offering deep insights into their experiences and needs. It’s a tool that not only educates but also inspires connection, empathy, and action. Our session will cover: 🌈 Collaborating with LGBTQ+ individuals to safely share their stories and co-design solutions. 🌈 Overcoming barriers to creating effective training for marginalised groups. 🌈 Balancing the power of storytelling with the need for engaging, actionable education. ‘See, Hear & Believe’ is more than a learning campaign; it’s a shift in how we develop and deliver training. By placing lived experiences at the centre, we’re creating community-driven solutions that prioritise safety, agency, and connection. This initiative is the result of collaboration between victim-survivors, healthcare professionals, law enforcement, and community leaders. Together, we’ve created a resource that equips frontline workers with the tools they need to support LGBTQ+ communities on their journey towards safety and healing. When we work within systems of oppression, When we exist within systems of oppression, When our identites, social locations and lived experiences are shaped by systems of oppression, it is crucial we acknowledge the position of self-care in relation to minoritised and marginalised communities. When we experience oppression, we also receive messages that we don't have the value to offer ourselves self-care, that we are not important enough to be taken care of. Self-care is an act of social justice. An act of equality. An act of value. An act of self-worth that challenges the dominant group 'norm' narrative of who we are. Anti-oppressive self-care invites us not to collude in the oppressors' message of dismissing, marginalising and oppressing our selves, our needs, our worth, our value and our equality. Anti-oppressive self-care sends the message that we are valuable and worthy of being taken care of.
