Attorneys often assume that opposing counsel and judges know just as much as they do about a case. Most especially for judges, this will almost never be true. So we should never act like it. One of the biggest mistakes I made as a younger attorney was to not make a judge's job as easy as possible. If an attorney has one job, it is to make a judge's job as easy as possible. If you're asking a court to make a decision on the evidence presented, therefore, an attorney must always, always, always be *painfully* clear on three issues: (1) what is the law?; (2) what are the facts? and (3) what are you asking the Court to do? This sounds simple enough, but, most especially with citing to a factual record - which is hugely time consuming - many attorneys simply fail to meet the mark. In case you're wondering how Courts feel about this, here's a real gem from the Ninth Circuit Federal Court of Appeal: See generally Christian Legal Soc. v. Wu, 626 F.3d 483, 488 (9th Cir. 2010) ("Judges are not like pigs, hunting for truffles buried in briefs." (quoting Greenwood v. FAA, 28 F.3d 971, 977 (9th Cir. 1994) (quoting United States v. Dunkel, 927 F.2d 955, 956 (7th Cir. 1991) (per curiam)) (alteration omitted)))) 😂

Some of appellate court decisions provide an excellent overview of the area of law that they are discussing and are a helpful starting point for any lawyer trying to learn that topic. Such is the case in Neisendorf v. Abbey Paving & Sealcoating Co., Inc., 2024 IL App (2d) 230209-U, which concerns the law under Restatement Sections 343 and 414 in the construction context. That decision is below. Other examples would be Williams v. Mack's, 2023 IL App (5th) 230264-U (unnatural accumulation), Monteagudo v. The Gardens of Belvidere, LLC, 2023 IL App (1st) 220045 (forum non conveniens), and Reynolds v. Jimmy John's Enterprises, 2013 IL App (4th) 120139 (procedure under section 2-619).
