Arbitration focuses on party autonomy, whereas insolvency processes are inherently concerned with the rights of third parties such as creditors as part of a collective remedy. Where these two systems interact, complex policy questions arise that cannot be addressed adequately by simply asserting the primacy of one system over the other. The recent Privy Council decision in Sian Participation Corp (in Liquidation) v Halimeda International Ltd [2024] UKPC 16 provides a topical reminder of the point.
