The case of Marcellus Williams, who faces execution in Missouri despite DNA evidence proving his innocence, highlights the consistent patterns of systemic racism within our justice system. His conviction was based on unreliable witness testimony and a lack of physical evidence. Despite evidence proving his innocence, the Missouri Attorney General’s office continues to try to block this evidence. Since the founding of this country, the burden of proving innocence for Black individuals has remained unjustly high. Historic biases have perpetuated the unfair belief that Black people are inherently criminal, undermining their right to equal protection under the law. These patterns aren’t new to Missouri and keep emerging, demonstrating the urgent need for police reform and a fairer legal system. We must expose these injustices and have a Courageous Conversation® to bring equality and justice for all. What Does "Jury of Your Peers" Really Mean? The phrase “jury of your peers” suggests that every person accused of a crime should be judged by individuals who share their lived experiences or come from their community. Historically, it was meant to ensure fairness. Peers were equals who could understand the circumstances of the accused. But in the U.S., systemic racism has often denied Black and oppressed people true representation in juries. Prosecutors routinely exclude jurors of color through practices like peremptory challenges, citing reasons rooted in stereotypes or bias. This leaves many defendants to be judged by juries that don't reflect their communities or understand the complexities of their experiences. Representation on juries is about justice. A system that silences the perspectives of Black people and others from oppressed communities in the courtroom upholds the delusion of white supremacy and perpetuates inequality. To achieve real justice, we must address these disparities and demand accountability in the selection of jurors. Missouri Governor Mike Parson and The Missouri Supreme Court should be ashamed of themselves. With ADMITTED Racial Discrimination, DNA testing NOT matching his on the murder weapon, and suggested evidence contamination by State Attorneys, The St. Louis Prosecuting Attorney’s Office told the court that it conceded the, “constitutional error of mishandling evidence” in Williams’ trial, and said “clear and convincing evidence,” of numerous constitutional errors in his prosecution were presented. Some quick facts about this case: 1.) DNA Evidence: DNA testing on the murder weapon did not match Williams2. Instead, it suggested contamination by state attorneys 2.) Racial Bias: Black jurors were replaced due to racial bias during the jury selection process. During selection, one prosecutor admitted to excluding a potential juror because of his race, which is illegal 3.) Victim’s Family and Prosecutor’s Opposition: Both the victim’s family and the prosecutor’s office opposed the execution, advocating for a life sentence instead 4.) Clemency Petition: Williams’ clemency petition highlighted these issues, but it was denied by the Missouri Supreme Court and Governor An extreme miscarriage of justice and all of these FACTS caused extreme doubt on the integrity of the judicial process. They fought for years to have this reversed only for Missouri officials to feed their egos and not admit any wrongdoing. Now a life is gone. As lynchings declined, the criminal legal system became a tool to continue racial violence under the guise of justice. Executions through the system disproportionately targeted Black communities, perpetuating the same dehumanization and oppression. It’s a stark reminder that our history of racial violence is deeply embedded in the structures we rely on today. There was an article published by the Guardian recently that discusses the case of Tyre Nichols’ beating death at the hand of several Black police officers with the Memphis Police Department. Tomorrow at least two of these scum of the Earth individuals will go on trial for the violation of Mr. Nichols’s civil rights. This notion of Civil Rights is a strange one when you really think about it. They are basically rights that supposedly guaranteed Black people, who had never been considered integral players in terms of decision making in the Anglo American white racial state, the rights to vote, own property, marry who they want,  when they want, serve on juries etc. etc. However, what civil rights really boil down to if you really understand it is the right of (certain) Black people to enter the established rules of hierarchy and domination. Isn’t it ironic that those Black officers who beat Mr. Nichols to death were exercising their “civil rights” to crack heads in the name of state and property? That’s not how it will be framed in their trial, but that is what they were doing. For decades, activists for the government have been lying to people talking Black officers will be better able to police Black communities? Has anyone ever thought that maybe Black people don’t want to be policed? Has anyone ever thought that Black people want to arrive on their own authority and control the judicial affairs of their own communities? The hogwash that the police protect and serve is utter nonsense. They are employed to protect and serve capital and the state and any perceived encroachment upon that edict has and will continue to be met with the most lethal and barbaric force. Even in the face of this reality, people still think organizations like the National Organization of Black Law Enforcement and the Ethical Society of Police are friends of the poor and oppressed. They are not. I am reposting an article I published through Medium closer to the time when Tyre Nichols was murdered by these brutes. I feel that my analysis, while centering around Tyre Nichols’s murder, covered broader terrain. i hope that someone might learn from what we have said in this article and maybe open up some dialogue regarding the issues therein.

Thank you to Essex County Circuit Court Clerk Christina Ambrose and her staff for loaning us two volumes of the county's "Registers of Free Negroes", 1810-1861, for our "Free Register" scanning project connected with Virginia Untold: The African American Narrative. We've scanned both volumes and will soon upload the images into our Virginia Untold database.   In 1793 and 1803, the Virginia General Assembly enacted legislation requiring "free Negroes or mulattoes . . . to be registered and numbered in a book to be kept by the town clerk, which shall specify age, name, color, status and by whom, and in what court emancipated." We've now digitized over 75 volumes representing free Black and multiracial people from across the state of Virginia from the late 18th century until the Civil War. https://bit.ly/3neRvFF   The Free Registers and other records that document free people of color demonstrate freedom on a spectrum for those who were not enslaved. While they may have been legally considered free, other laws restricted their movement by requiring money and passes to travel about the state. If free Black or multiracial individuals were found to be without a free certificate, they could be put in jail. After 1806, recently emancipated individuals had to receive special permission to remain in the state of Virginia.    This week the country celebrates Juneteenth.
