I attended a webinar this morning that was hosted by the Wine & Spirits Wholesalers of America (WSWA) where Dina Opici Wallach, Dawson Hobbs, and Theo Koebel outlined the potential harm of proposed tariffs on imported wine and spirits. Their insights underscored the widespread adverse effects these tariffs would have on the industry, including increased consumer prices, strained trade relations, and economic instability for retailers, distributors, and hospitality businesses. WSWA opposes these tariffs, emphasizing the essential role of imported wines and spirits in driving industry growth and consumer choice. Leaders highlighted how tariffs on products like tequila, champagne and Scotch whisky could prompt retaliatory trade measures, compounding the damage. The discussion reinforced the need for collaborative trade policies that support the industry and protect jobs, innovation, and market diversity. This decision is suspicious. BC liquor licences prohibit licence holders from freedom of speech around announcing the presence of police officers or other regulatory staff. From the licence: "your actions must not cause the attention or focus of patrons to shift towards inspectors, minor agents contracted to the branch, or police at any time" The licence goes on to claim this prohibition is about the safety of the inspector or police officer, but I call BS. The goal is to ensure the state has an easier time obtaining evidence of offences. Unfortunately, the clear s. 2(b) Charter issue (and the attempt at insulating the breach under s. 1 in the name of protecting the safety of police) was not addressed in the decision. #adminlaw #regulatorylaw #criminallaw #civilliberties

The Punjab & Haryana High Court recently denied an anticipatory bail plea for Usha Rani, a woman with a history of manufacturing and selling illicit liquor. The court emphasized the severe societal harm caused by spurious liquor and the importance of upholding public safety. Justice Anoop Chitkara, while rejecting the bail plea, noted, "Spurious liquor can cause devastating trauma and huge tragedy, affecting poor people who opt for cheaper alternatives. Such liquor often contains lethal methyl alcohol. The petitioner’s involvement in distilling and trading illicit liquor poses a significant threat to society." The court's decision was influenced by Usha Rani's extensive criminal history, including 21 cases, seven of which resulted in convictions under the Excise Act. The State's counsel highlighted the numerous incidents of fatalities due to spurious liquor, arguing against granting bail. The court observed that the petitioner had not filed any complaints against the Sarpanch, who she claimed was falsely implicating her. The decision aligns with the Supreme Court's stance, which in 2022 criticized the Punjab government for its inadequate action against the manufacture and sale of illicit liquor. The court reiterated the need for stringent measures to combat this menace, reinforcing the importance of adhering to food quality standards in liquor manufacturing to prevent societal havoc. In this case, the High Court's ruling underscores the judicial commitment to maintaining public safety and health by strictly regulating the manufacture and sale of alcoholic beverages. The legal principle that anticipatory bail should not be granted in cases involving severe threats to public safety was firmly applied.
