Australian Competition & Consumer Commission (ACCC) has commenced a market inquiry into the proposed acquisition of Silk Logistics Holdings Limited by DP World To help inform the Freight & Trade Alliance (FTA) submission please share your views with Tom Jensen via email at tjensen@ftalliance.com.au The ACCC is specifically inviting submissions on the following concerns: Potential Discrimination: Whether a combined DP World Australia/Silk entity could favour its own port logistics operations, such as through preferential Vehicle Booking System (VBS) slot allocations, reduced or waived Terminal Access Charges (TACs), or other favourable terms, to the detriment of competing landside transport operators. Impact on Competition: The extent to which competition may be reduced at various levels of the supply chain, including landside transport, port logistics, and stevedoring services. Bundling of Services: The likelihood of DP World Australia leveraging its container stevedoring and empty container park services to bundle offerings with Silk’s port logistics business, and how this may limit competition. Access to Sensitive Information: Whether commercially sensitive data held by DP World Australia or Silk could be used to gain a competitive advantage over rival service providers. Coordination Risk: The potential for increased coordination between vertically integrated stevedores, such as DP World Australia/Silk and Patrick Terminals/Qube, which could lead to price increases or reduced service quality. https://lnkd.in/gmB6BKkH
