Ros Prince's generous words on Stephenson Harwood LLP's recent ranking in Global Investigations Review are spot on. Hence the re-post. The GIR 100 commentary highlights the Singapore office and "Jonathan Goacher, who is one of the top sanctions experts in Asia. The Singapore office is also home to Christopher Bailey, an international arbitration partner with extensive investigations experience." One benefit of two decades in Asia has been the breadth of opportunity and experience, and investigations has without question featured alongside my arbitration practice. I have been fortunate to work for both Asian and US clients on these matters; before the US DOJ, the UK SFO and numerous local regulators; in relation to business in Africa, Asia and the Middle East; and to collaborate with leading US firm investigation partners. Particular credit to King & Spalding, Sidley Austin LLP, Hughes Hubbard & Reed LLP and Moore & Van Allen PLLC. At Jencap Partners, we believe that the FOS should embrace precedents for a more consistent and fair approach. Why? 👇 ➡️ 𝗖𝗼𝗻𝘀𝗶𝘀𝘁𝗲𝗻𝗰𝘆 𝗮𝗻𝗱 𝗽𝗿𝗲𝗱𝗶𝗰𝘁𝗮𝗯𝗶𝗹𝗶𝘁𝘆 Setting precedents ensures that similar cases are handled consistently. This allows individuals and advice firms to plan their actions with confidence, promoting stability within the FOS. ➡️ 𝗘𝗳𝗳𝗶𝗰𝗶𝗲𝗻𝗰𝘆 By relying on past decisions, the FOS can resolve cases more efficiently. This speeds up the decision-making process and avoids redundant evaluations. ➡️ 𝗙𝗮𝗶𝗿𝗻𝗲𝘀𝘀 The application of precedent helps to ensure that similar cases are treated alike, promoting fairness in the system. This helps to avoid arbitrary or biased decisions. ➡️ 𝗟𝗲𝗴𝗶𝘁𝗶𝗺𝗮𝗰𝘆 𝗮𝗻𝗱 𝗮𝘂𝘁𝗵𝗼𝗿𝗶𝘁𝘆 Relying on established precedents enhances the FOS's credibility. It shows that decisions are based on tested principles rather than personal discretion. What are your thoughts on the role of precedents in ensuring fairness and efficiency within the FOS? 👇

Hong Kong - you have been excellent! It was an honour to be invited as guest speaker by Charles Russell Speechlys to their HK Breakfast Roundtable discussion featuring each of their global arbitration partners, Thomas R. Snider, Richard Kiddell, Stephen Chan and Peter Brabant. The interactive discussion with the attendees who came from varied backgrounds (institutions, clients, investigations, forensic accounting, barristers) marked a meaningful end for me to all the ICCA 2024 Hong Kong side events I attended last week! Key takeaways include: 1. Discussion of the opt-in or opt-out for expedited arbitrations and whether there is some strategy behind "taking it slow" in arbitrations. 2. The Outcome-Related Fee Structures (ORFS) in Hong Kong and its current uptake to date since Dec 2022. 3. How litigation insurance such as After-the-Event insurance, award preservation and adverse award insurance could help in managing cash flow and taking these contingencies off balance sheet. #internationalarbitration #disputeresolution #costmanagement #cashflow
Thank you to everyone who joined us yesterday for a breakfast roundtable discussion moderated by Thomas R. Snider, featuring our panellists Richard Kiddell, Stephen Chan, Peter Brabant and our guest speaker Cathryn Neo, FCIArb FSIArb, Associate Director of Aon. They addressed some of the most important and crucial areas concerning the management of costs and cashflow in international arbitration. We are delighted to engage in meaningful discussions with stakeholders in the field of arbitration. We look forward to more knowledge and idea exchange at another event soon! #internationalarbitration #costmanagement #cashflow #disputes #legalservice #seminar #networking
