UK MAIB investigation report reveals findings on the Fatality incident aboard the Bulk carrier Equinox Seas in April 2023. The report, published in September 2024, highlighted key factors contributing to the accident: Two findings I will highlight below: - The fitter breached a tape barrier at the fan room access, potentially impacted by reduced alertness at the time of day. - Lack of clear safety management guidance in ship repair facilities led to a misunderstanding of safety responsibilities. ** There was no mention of whether or not any BAC test was carried out in the now decreased Fitter ? When you see on pages 7, 11, 12, 13 - one has to take a meditated deep breath and ask the questions WHY ? WHY did the deceased not see the Danger ? A seafarer will be negligent when performing any task if he does not exercise the necessary skill to be reasonably expected from somebody of that rank when carrying out that task or duty. Seafarers play a critical role in ensuring the safety and efficiency of maritime operations. Failing to meet the necessary skill level can lead to negligence or incompetence in performing tasks onboard. The STCW Convention emphasizes the importance of seafarers being properly qualified, with shipowners required to define crew competence levels through the ISM Code. Shipowners must adhere to industry standards in recruitment and training to avoid rendering the vessel unseaworthy due to an incompetent crew. Allegations of incompetence often stem from inadequate training in the face of increasingly complex ships. A shipowner's legal defense can be compromised by crew actions, highlighting the need for stringent compliance with seafarer employment, training, and certification obligations. The evolving standards require shipowners to prioritize continuous training and development to meet the expectations of a 'reasonable' shipowner. Adapting to new industry developments is crucial to ensure seafarers are equipped to navigate modern vessels effectively. By upholding legal obligations and maintaining high training standards, shipowners can safeguard their operations and crew members effectively. Attention Seafarers and Maritime Companies! 🚢 Lately, there's been a significant rise in companies requesting seafarers to obtain numerous expensive certifications. While I fully understand the importance of maintaining high standards and ensuring safety at sea, it's crucial to address a key point: if these certifications are not mandatory under STCW requirements, the cost should be borne by the company, not the individual seafarer. Seafarers already invest a substantial amount of time and money into their careers. In compliance with the SOLAS (Safety of Life at Sea), IMO (International Maritime Organization) resolutions, and the STCW (Standards of Training, Certification, and Watchkeeping for Seafarers) 2010 amendments, onboard familiarization is indispensable for ensuring safety and enhancing operational efficiency. Within the initial two weeks of embarkation, it is imperative that the crew undergoes comprehensive training and familiarization with the vessel’s safety equipment, emergency procedures, specific roles, and environmental conditions. The STCW 2010 amendments have bolstered these requirements, placing a strong emphasis on continuous training and competency as foundational elements of maritime safety. Under STCW regulations, every crew member must demonstrate proficiency in their designated responsibilities, which includes mastering the use and management of the ship’s safety equipment. This covers an extensive understanding of lifesaving devices, maritime survival techniques, and firefighting protocols, enabling each crew member to respond effectively in emergency situations. The duty to ensure adequate training is incumbent upon the vessel’s commanders and senior officers. They are obligated to guarantee that all crew members are not only well-informed but also consistently updated on the latest safety procedures and technological advancements. Investing time and resources in training and familiarization is critical not merely for compliance with international standards but also for the assurance of safety on board. The amendments introduced by STCW have set new benchmarks to ensure that training is capable of meeting the contemporary challenges faced by the maritime industry.
