New York’s new Freelance Isn’t Free Act (FIFA) is now law, and if you work with independent contractors, it’s time to pay attention. Effective August 28, 2024, this law mandates written contracts for freelancers performing services worth $800 or more. These contracts must include specific details about the work, payment terms, and more—failure to comply could cost you. Here’s what employers need to know: Written Contracts: Every agreement with freelancers should be documented, covering all required elements like service details and payment terms. Timely Payment: Freelancers must be paid by the contract’s due date, or within 30 days if not specified. Retaliation: Be aware that the law prohibits any form of discrimination or retaliation against freelancers who assert their rights. Penalties for non-compliance are steep, including fines and the risk of double damages. The Attorney General has enforcement power, and freelancers can also bring private lawsuits. If your business relies on freelance talent, now is the time to review and update your processes. Don’t wait until August to get your contracts and payment systems in order. The cost of ignoring this new law could be significant. For more detailed guidance on ensuring compliance, feel free to reach out. #contractor #freelancer #nylaw #lawyer

Great legal news for freelancers: The Freelance Worker Protection Act was signed into California law on September 28th! That means California joins the likes of Illinois and New York which have similar laws, like New York’s infamous “Freelance Isn’t Free” law. But what does it mean for freelancers? It means more protection from exploitation, including written contract requirements, 30-day payment terms, anti-retaliation protection, and options for legal recourse if things go sideways. This is huge news! We can only hope this inspires more states to adopt laws protecting freelancers. PS My legal course, ContractYOUally™️ is on sale until the end of the year, to help you set up your legal foundation before this law goes into effect in January. Do you have a contract for that? – Hiring Independent Contractors and Freelance Workers under the New York State’s Freelance Isn’t Free Act New York State recently adopted a new law known as the Freelance Isn’t Free Act (the “NYS Act”), as Article 44-A of the General Business Law. The NYS Act follows in the footsteps of a New York City law by the same name. Both laws address independent contractor arrangements and offer protections to certain independent contractors or freelance workers, as defined in the NYS Act and the New York City law. However, the two laws vary in some aspects. Below is a description of the NYS Act’s requirements and provisions. In #freelancing news, the state of New York has enacted "strong legal protections against nonpayment and retaliation" with the Freelance Isn’t Free Law that went into effect on August 28th. 📰 What does this mean? In short, the law "addresses the growing issue of nonpayment among freelancers." As the freelance economy grows, workers must receive the protection they need to secure payment and stability. I imagine we'll continue to see more measures such as this across the U.S. soon. #FreelanceWork #FreelanceNews

BIG DAY! The Freelance Worker Protection Act goes into effect in Illinois! 🎉 Things I've had happen to me as a freelancer: - Client paid 3 weeks late - Client tried to get me to accept less money in exchange for paying the invoice - Client completely ghosted, never paid ^ All of these would now be illegal under FWPA FWPA is modeled after New York City's Freelance Isn't Free Act. Since it went into effect in 2017, the New York law has recovered millions in unpaid invoices for freelancers. I personally know this law is effective. Mere mention of the law to a delinquent client of mine (that he would owe me double the original invoice) resulted in the invoice being paid the same day. Spread the word! This laws applies to freelancers living in Illinois OR businesses hiring freelancers in Illinois. #FreelanceWorkerProtectionAct
