If you are an applicable large employer OR any size employer that offers a self/level funded plan and haven't completed your 2023 ACA filing, time is about to run out! There are several important deadlines to know to comply with ACA reporting requirements this year: ⭐ The ACA 1095-B and 1095-C furnishing deadline was March 1, 2024. By this date, employers should've furnished copies of these forms to their employees. ⭐The IRS electronic filing deadline is April 1, 2024. ⭐Employers that operate in certain states may also have additional state requirements. The non-compliance penalties for 2024 have increased to: ⭐$60 per return if filed within 30 days of the due date. ⭐$120 per return if filed 31 days late through August 1. ⭐$310 per return if filed after August 1. ⭐$630 per return for intentional disregard. You do sometimes wonder about HMRC's approach. In May 2024, HMRC changed its guidance Compliance Handbook on Information Notices at CH24340 to now say the time limit is now "within 30 days of the date on the information notice"❗ Previously HMRC's guidance accepted that a person must submit an appeal within 30 days of the date on which the information notice was received. The legislation at Para 32 (1b) states "before the end of the period of 30 days beginning with the date on which the information notice is given," HMRC has not explained why it has changed this approach given that it had from when the legislation was enacted accepted that the appeal period was 30 days from received and not issued. If it was the latter, then why wasn't the legislation drafted to specifically mention "30 days from date of issue"? Perhaps I have missed HMRC publication which advises why it has taken a different position. If it hasn't it would be good to know, as HMRC has narrowed the time to respond to an Information Notice, especially in instances where the Information Notice has taken over 1 week to reach the recipient....... #hmrc #appeals #Informationnotice #enquiries
