Honoring Our Heroes: The Impact of Expert Testimony on Military Conscription Laws As we continue our Memorial Day weekend series, reflecting on pivotal moments in military history and the legal battles that shape our armed forces, we remember Memorial Day, originally known as Decoration Day, to honor U.S. military personnel who died while serving. In our second post, we revisit the significant case of *Rostker v. Goldberg* (1981), where the Supreme Court upheld the male-only requirement for selective service registration. This decision highlighted Congress’s constitutional authority to make gender-based distinctions in military conscription. Military law and gender studies experts played a crucial role in this case. Their testimonies acknowledged the significant contributions of women in non-combat roles and reflected the prevailing military and societal attitudes towards drafting women. Despite recognizing the capabilities of female servicemembers, both military experts and Congress maintained that the selective service should focus on men due to combat restrictions. Important news from AmeriCorps and the United States Department of Defense yesterday. The two organizations announced the re-establishment of a partnership that strengthens the pathways for young people to serve our country. Specifically, the memorandum signed will provide information and access to service opportunities in AmeriCorps NCCC for individuals not eligible or selected for military service. We applaud this agreement. It's a meaningful step to make service years both a common expectation and opportunity for all young Americans. For more on the partnership: https://lnkd.in/dATHeVVT “Service is service in all its forms,” said Shawn Skelly, about the agreement. Skelly is Performing the Duties of Deputy Under Secretary of Defense for Personnel and Readiness, and helped lead the National Commission on Military, National, and Public Service. The Commission shared 154 recommendations in 2020, like the agreement just announced, that move us closer to a "whole of government" approach to service.
