In the latest judgment involving the case of P&ID’s dispute with the Federal Republic of Nigeria, the Court of Appeal held that it had jurisdiction in principle to hear Process & Industrial Developments’ appeal to a costs order, made at first instance. However, on the merits, the appeal was dismissed, confirming the position when it comes to the separate question of the currency in which the court should order costs. Once, I had the opportunity to listen to an inspiring speech by Justice (Retd.) Dr Fauz Twaib during the 4th Victory Attorneys Moot Court on the regulation of Carbon-credit trading. In his speech, Dr. Twaib highlighted several important issues. Here are a few that I found particularly helpful: 1. Diversity: As a lawyer and legal practitioner, it is essential to diversify your fields of practice to gain varied experience. Dr. Twaib emphasized the importance of broadening one’s practice to include commercial, social, and other matters. 2. Staying Updated: Lawyers need to stay informed about emerging issues affecting both the legal and extralegal fields. Dr. Twaib encouraged young lawyers to stay updated and knowledgeable about current developments in technology and legal aspects such as cryptocurrencies and carbon trading. 3. Emotional Intelligence: Dr. Twaib highlighted the necessity of maintaining peace of mind and emotional stability in legal practice. He stressed the importance of learning emotional intelligence to manage emotions effectively, especially when facing challenging situations that could impact emotional stability. Justice (Retd.) Dr Fauz Twaib is a retired Judge of the High Court and Justice of Appeal of the Court of Appeal of Tanzania. He is currently the President of the East Africa Law Society. Given his esteemed status, position, and extensive experience in the legal field, I find his insights persuasive and encouraging. After wandering about, I'm back to talk on law 🫢 Let's briefly take a look at limitation of action in Nigeria. It's a fundamental principle of law that every individual has the right to fair hearing P.D.P. v. I.N.E.C. (1999) 11 NWLR (Pt. 626) 200. However, there are situations where by you can't be heard by the court anymore, because you've slept on your right. Timing in law is of great relevance, everything is timed, and it is expected of a concerned party to stick to the timing, be it a statutory or procedural one. An equitable maxim that fits in to our discussion at hand, is, Equity aids the vigilant and not the indolent (Delay defeats Equity). In law, various kind of actions have their statutory deadlines, if your suit is not instituted before the deadline then you can't institute same in court again. In EBIOGBE vs. NNPC (1994) 5 NWLR (Pt. 347) 649 the court asserted that: where a statute prescribed a period within which an action must be commenced, legal proceedings cannot be properly or validly be instituted after the expiration of the prescribed period. The central legislation governing the issue of limitation is the " THE LIMITATION OF ACTIONS ACT". Let's make it brief, tomorrow we'll pick up from where we stop. #lmc21dayslinkedinchallenge
