Last week, the EPA released significant news regarding federal PFAS regulations. Here are the highlights. Historic Regulation - The EPA has released final National Primary Drinking Water Regulation (NPDWR) for six PFAS, aiming to protect 100 million people from these chemicals in drinking water. Impactful Changes - Organizations with private wells, remediation obligations, or NPDES discharges will face significant, costly impacts. MCLs Established - Enforceable Maximum Contaminant Levels (MCLs) set for PFOA, PFOS, PFNA, HFPO-DA, and PFHxS, with a mixture approach for managing combined PFAS concentrations. Compliance and Flexibility - Public water systems have three years for initial monitoring, with a five-year deadline for corrective actions. The rule includes flexibilities for small systems and reduced monitoring based on results. It's official: IDEM has recognized the Federal PFAS Maximum Contaminant Levels ("MCLs"). These new IDEM Published Levels will go into effect 6/25/24 and are the same parts per trillion ("ppt") levels as specified by the USEPA. EPA's New PFAS Regulation Marks Major Step for Safer Drinking Water! A significant step forward for clean water has been achieved. Following rigorous technical assessment and extensive public input, the EPA has recently unveiled the final NPDWR (National Primary Drinking Water Regulation) https://lnkd.in/gdKqXZUh aimed at regulating PFAS in drinking water. This long-anticipated regulation establishes legally binding maximum contaminant levels, offering crucial protection against these persistent "forever chemicals”. We are celebrating this milestone with the many affected communities who tirelessly advocated to bring this critical issue to public attention. While this is indeed a pivotal moment for PFAS risk management, we recognize that our journey is far from over. I'm surprised my notifications aren't going haywire on this policy's release. Please share your thoughts. (Note emphasis is on drinking water wells) "...To ensure cleanup begins as quickly as possible, the DoD Components will initiate removal actions to address private drinking water wells impacted by PFAS from DoD activities where concentrations are known to be at or above three times the MCL values...This approach prioritizes action where PFAS levels from DoD releases are the highest (i.e., at or above three times the MCL values), rather than delay action at these locations while ongoing remedial investigations continue...." https://lnkd.in/esnaCPks #pfas

More PFAS-related news! EPA has finalized its rule to include PFOA and PFOS under CERCLA as hazardous substances. Some quick takes from EPA's announcement: * The Rule requires entities to immediately report releases of PFOA and PFOS that meet or exceed the reportable quantity of 1 pound within a 24-hour period. * EPA will focus enforcement on parties who significantly contributed to the release of PFAS chemicals into the environment, including parties that have manufactured PFAS or used PFAS in the manufacturing process, federal facilities, and other industrial parties. * EPA does not intend to pursue entities where equitable factors do not support seeking response actions or costs under CERCLA, including farmers, municipal landfills, water utilities, municipal airports, and local fire departments.

Earlier today, the Office of Management and Budget (OMB) posted on its website that it has completed its review of US Environmental Protection Agency (EPA)'s final National Primary Drinking Water Regulation for #PFAS. With this last hurdle completed, we anticipate #EPA will announce the proposed MCLs and Hazard Index quickly, likely within the next two weeks. This news mirrors the information received by WaterPIO in recent weeks that the EPA would announce the final MCLs by mid-April, followed by a formal event in Wilmington, North Carolina. There is no word on what the final MCLs and Hazard Index are. However, many believe - because Wilmington is the choice for the formal event - the proposed MCLs and Hazard Index are not being changed. (Wilmington was where the proposed MCLs and Hazard Index were announced in March 2023.) Today, the U.S. EPA finalized a rule to designate two widely used PFAS chemicals, PFOA and PFOS, as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Under the rule, entities are required to immediately report releases of PFOA and PFOS that meet or exceed the reportable quantity of one pound within a 24-hour period.
