Stop saying you have a provisional patent. 5 steps to see how this HURTS startups: 1. A founder sees they need to get their IP going. 2. They look into getting a patent and see that utility patents are expensive, but that they can file something called a provisional application for patent. 3. They file their pitch deck or a quick write-up. 4. They tell potential investors they have a provisional patent. 5. No investor takes them seriously because they know this key fact: → There is no such thing as a “provisional patent.” It simply doesn’t exist. What does exist (and what that founder filed) is a provisional patent APPLICATION. There’s no need to make it out to be something it’s not because it already gives you: → a priority date → room to maneuver → patent pending status → more time to make decisions → the ability to delay patent costs If it makes sense for your IP strategy, use a provisional patent application.
