Happy Halloween! Trick or treat - A rare treat introduced in the Autumn Budget for Non-Doms. Although the 10 year tax tail is more trick than treat - at least we now have certainty over the nebulous concept of domicile. I have a number of clients who will sleep soundly after 6th April knowing they have definitively escaped the clutches of the UK IHT net. In general terms, the new measures being introduced in April will mean that if you die 10 years non-UK resident, then your estate will not suffer IHT on assets situate outside of the UK. Individuals in Jersey with businesses in the UK or have not completed the full 10 years should really revisit their Wills and estate planning. For example, partial Business Property IHT relief of £1M will be retained. However, this is non-transferable. If you don’t use it you will lose it. So, if you leave your business assets to a spouse then you will potentially waste the £1M IHT relief. We plan your succession and work hand in hand with your tax advisers both in Jersey and the UK to help ensure - for you at least - the UK budget is more treat than trick.
