Yesterday, our legal interns, Nisanur Serçe and Berat Kaan Güneş, attended the seminar on New York Convention organized by Istanbul Arbitration Centre / ISTAC, in collaboration with the International Section of the New York State Bar Association. In the first session moderated by Okan Demirkan and featuring Dr. Ziya Akinci, Carolyn Lamm and Ling YANG FCIArb, the following topics were discussed: 🖋Enforcement of arbitral awards in Türkiye, 🖋Current trends in the enforcement of arbitral awards in the U.S., and 🖋Recognition and enforcement of arbitral awards in China and Hong Kong. Singapore International Arbitration Centre (SIAC) officially released the 7th Edition of the SIAC Arbitration Rules on 9 December, which will come into force on 1 January 2025. Given SIAC’s position as the second most preferred arbitral institution globally and the rise of Singapore as the top global hub for international arbitration, these updates have the potential for wide-reaching impacts and may lead other institutions to adopt similar changes. This is the first update to the rules in almost nine years following a lengthy and extensive consultation. The rules introduce new procedures and confer additional powers and duties on tribunals aimed at improving efficiency in the conduct of proceedings. Whilst the existing framework for SIAC arbitrations is preserved, these new provisions are likely to impact procedural strategy and maneuvering. Of particular note is the conferral of power on emergency arbitrators to issue ex parte relief (without notice to the respondent). If followed by other leading arbitral institutes, this approach could represent a paradigm shift for emergency arbitration. The new rules apply by default to arbitrations commenced on or after 1 January 2025 regardless of when the arbitration agreement was entered into (unless it references an earlier version of the rules, in which case that version will apply). 𝗩𝗜𝗔𝗖 𝗲𝗻𝗵𝗮𝗻𝗰𝗲𝘀 𝗮𝗰𝗰𝗲𝘀𝘀𝗶𝗯𝗶𝗹𝗶𝘁𝘆 𝘁𝗼 𝘁𝗵𝗲 𝗩𝗶𝗲𝗻𝗻𝗮 𝗥𝘂𝗹𝗲𝘀 𝗮𝗻𝗱 𝗽𝗿𝗼𝗺𝗼𝘁𝗲𝘀 𝘁𝗿𝗮𝗻𝘀𝗽𝗮𝗿𝗲𝗻𝗰𝘆 When the Vienna Rules were updated in 𝟮𝟬𝟬𝟲, VIAC initiated an ongoing project to bring the Rules closer to users worldwide. The 𝟮𝟬𝟮𝟭 Vienna Rules have been translated into 11 different languages. The VIAC Handbook, which was published in 𝟮𝟬𝟭𝟯 and 𝟮𝟬𝟭𝟴 is designed for practitioners, it has each article of the rules reproduced in their entirety and provides detailed comments and background information on the amendments. The new edition of the VIAC Handbook, dedicated to the 50th Anniversary of VIAC will be published in October 𝟮𝟬𝟮𝟱. VIAC’s Selected Arbitral Awards, Volumes I (published in 𝟮𝟬𝟭𝟱) and II (available online since 𝟮𝟬𝟮𝟰), provide a unique and valuable insight into various important and challenging procedural and substantive issues that have arisen over the years. Such publications foster greater familiarity, predictability, and confidence in the international arbitral process. To further foster transparency, VIAC also publishes the names of all arbitrators acting in VIAC cases where the file has already been transferred to the arbitral tribunal (the list is available here).
