🌍 EU Court to Decide on Critical Doping Case ⚖️ 🔹 Issue at Hand: This Tuesday, a significant ruling from the EU Court of Justice is expected concerning sports law and data privacy. The court will determine whether Austria's anti-doping authority acted within legal boundaries when it published the name, details of the doping violation, and suspension period of an athlete on its website. 🔹 GDPR Concerns: Central to this case is the balance between public interest in the integrity of sports and individual rights under the General Data Protection Regulation (GDPR). Was the publication a necessary measure for sports transparency, or did it infringe upon personal data protection rights? 🔹 Competence Questioned: Additionally, the competence of Austria's highest sports arbitration tribunal, USK, to refer the question to the EU Court of Justice is under scrutiny. Is this referral admissible? 🔹 Advocate General's Opinion: The Advocate General has deemed the case admissible, suggesting that the anti-doping authority was justified in publishing the athlete's personal data related to the doping violation. 👀 Stay tuned as we await the court's decision, evaluating the balance between effective enforcement of anti-doping rules and the protection of athlete data in Europe. 🔔 Follow for Updates: Make sure to follow for a concise and easy-to-understand summary as soon as the verdict is out. Courts too are to apply data protection rules, even when they publish judicial decisions. Depending on what we attribute to the notion of judicial capacity, Supervisory Authorities may (not) have the competence. Under "we" I mean the national legal system and interpretation thereof. The power of SA may be excluded in order to safeguard the independence of the judiciary in the performance of its judicial tasks. I was privileged to have been given an opportunity to work with Luís Neto Galvão and join incredible #CouncilOfEurope #TJENI Project team - Elena Yurkina & Biljana Nikolic and develop a new #CoEHELP course: Personal Data Protection in Publication of Judicial Decisions I do admit being biased BUT the beautiful design of the materials, video clips to better present relevant cases of the #CJEU and #ECtHR, as well as many practical examples made this rather underrepresented, and complex subject lacking strict rules manageable. as, #privacy matters! #GDPR #ECHR #DataProtection #RightToPrivacy
Exciting News! Our new online course on protecting personal data in publication of judicial decisions is live! The course was developed under the TJENI project. Developed by a team of privacy and data protection experts in cooperation with COE HELP the course offers invaluable insights into navigating the complex balance between legal transparency and the right to privacy.
