Great to see a regulator being proactive around payment systems. firms should gain benefit in the future in their insurance premiums by the development in this space, the risk of fraud is substantially reduced. For once as practitioners we may have the potential to move the risk to somewhere else!

As a notary, our primary role in preventing fraud is to ensure that documents are signed and executed lawfully and authentically. This starts with verifying the identity of the signer through valid government-issued IDs and confirming that the signer is acting voluntarily and competently. Notaries must also ensure that the document is complete and not left blank before notarizing it, as any alterations can lead to fraud. Maintaining a notary journal to document the details of each notarization, including the date, type of document, and identities of signers, provides a valuable record if the validity of the notarization is questioned. Additionally, using a unique notary seal helps deter fraudulent activities. If any suspicions arise about the document or the signer's intentions, the notary should refuse to notarize it. The legal profession is being urged to maintain vigilance in identifying suspicious activity in property transactions after research indicated a 13% year-on-year decline in the number of Suspicious Activity Reports (SARs) filed by legal and conveyancing professionals. According to the SARs Annual Statistical Report 2023, the number of SARs submitted by independent legal and conveyancing professionals dropped from 2,859 in the 2021-2022 fiscal year to 2,526 in 2022-2023. While this could be seen as a positive, there are clearly still concerns that need to be addressed. A series of red flags remain for lawyers and conveyancers attempting to complete client due diligence including third party proxy and irregularities within source of funds.
