In the world of foreign subsidy regulation, October 2024 was a significant month. We saw two major events from both sides of the Atlantic: (1) new HSR forms were adopted in the U.S. to include foreign subsidy information; and (2) a business in Europe leveraged existing foreign subsidy review tools to challenge (alleged) public procurement tenders. The events follow two significant “firsts” under the (relatively new) EU foreign subsidy regulation (“EU FSR”), both of which have taken place in the last month: (i) the Commission provided confidence to international investors as it cleared a transaction involving a Chinese acquiring entity; and (ii) the Commission provided an insight into the types of remedies it might seek in the context of a transaction to address perceived concerns, as it issued its first conditional decision in relation to a transaction.
