A neat encapsulation of reporting fatigue - 'just one more rabbit hole to chase down' to maintain the veneer of activity, when we need to 'look up' and see the need for and deliver the reality of transformation. Good reporting is the first rung on that transformational ladder, it provides the foundations for change (the web of connections across value chains, the datasets, the baselines etc) but its for naught if you don't push on to deliver a radical reduction in the impact of your supply chains, operations and products/services. Too many C-Suites hiding behind this veneer to avoid the 'hard yards' of transformational change

As the public demand for both climate action and accountability keeps growing, jurisdictions worldwide have drafted legislation on greenwashing to satiate this appetite. Today, organisations that make unsubstantiated sustainability claims expose themselves to regulatory risk, but the legal definition of Greenwashing and how it is prosecuted varies greatly from jurisdiction to jurisdiction. A few thoughts from our event on ESG regulation - thanks to BritishAmerican Business and excellent panelists Thierry Panhelleux, Ulysses Smith, Patricia Volhard, Duncan Edwards: - To understand EU ESG regulation it helps to understand the scope and ambition of the Green Deal - ESG regulations across markets share some common roots and architecture, but the underlying policy objectives may account for the difference in scope - Understanding the picture in the USA requires a look at Federal rule making but also at the State level (which presents a divergent picture) - Many companies have underestimated the extent of the readiness effort for CSRD; it is important to get started, with more than adequate resourcing and support - CSDDD will be an important directive for companies to address given its extensive requirements, including Transition Plans, and expansive regime for complaints, litigation, and sanctions - These regulations require more than a compliance mindset, as many have significant strategic and operational implications Debevoise & Plimpton EY #esg #sustainability #corpgov #sustainability

When an organisation markets its products and services as being “environmentally friendly” or “carbon neutral”, are they really? Making unsubstantiated environmental claims for marketing purposes is called greenwashing, and in some jurisdictions such claims are punishable by law. At a time when businesses are scrambling to meet stakeholders’ climate expectations, it is important to understand the legal risks attached to greenwashing and its potential reputational implications. ESG regulations have reportedly risen 155% globally in the last decade📈 Inconsistent ESG disclosures across jurisdictions, company sizes, and sectors have created a fragmented landscape that hinders comparability and transparency. At COP29, the International Organization for Standardization (ISO) is launching new, freely available international guidance. This initiative aims to help organizations navigate the complex ESG landscape, comply with disclosure requirements, and accurately measure, report, and communicate their activities.
