Now that ASEAN has embarked on a new journey by entering into a new FTA negation to open new market and to attract more FDI into the region, NT, MFN, Disputes Settlement, among others, are challenging elements among us in Working Group on Investment, given the diversities, new policy trends and level of developments among ASEAN Member States. Reform of FDI Screening in the EU Great to work with colleagues in Brussels and across Europe on this update about reforms to FDI screening in the EU. Several important substantive and procedural changes are being considered which those involved with M+A deals in sensitive sectors should be take note of. Although a more co-ordinated approach by European FDI authorities is likely to be a positive step, there's still quite a lot which needs clarifying...

The report emphasizes the rise in notifications and the expansion of sectors considered high risk for potential review. The increased scrutiny and high notification rates in specific member states call for investors' thorough due diligence and a understanding of FDI screening mechanisms in a growing complex regulatory environment.

There is no control of FDI. That's what I said. That's what's true. The Law on Investments proclaims the principle of national treatment to foreign investors and prohibits discriminatory practices against them.  The Law also allows the repatriation of profits and dividends, provides guarantees against expropriation, allows waivers of customs duty for equipment imported as capital in-kind, and enables foreign investors to qualify for government incentives and subsidies.
