President Lyndon Johnson, 36th US president I never knew there is an aspect of law called space law until the last day of the mentorship session at Legal Ideas Forum with Nelly-helen Ebruka The ideas behind space law is to Regulate and govern the world beyond the imaginable and to support sustainability of the world in general. During the session with Nelly-helen Ebruka , she talked about the usefulness of space which include but is not limited to weather and climate monitoring satellites, Satellite based internet service, enhancing telecommunication and connectivity, improving weather forecasting and disaster Management, fostering innovations and technological advancements, etc She also talked about the reasons why we should chart a career in space law and the reason is because the space is inherently International in nature which involves multiple countries and Organisations and so we should see it as part of international law. Also, space law is seen as a new market or industry of the future so it is something we can delve in for future purposes. Thanks to Legal Ideas Forum for this amazing internship programme. Grateful for an Enriching Experience! I'm thrilled to share the successful completion of my 5-week internship (06/10/2023 - 10/11/2023) at Aarde Law Chambers - Trademark & Patent Attorneys, which marked a significant milestone as my first proper foray into the field of Intellectual Property Rights (IPR). This internship was a learning experience which solidified my passion for IPR law. I am particularly thankful to my senior and mentor during the internship, Adv. Akshatha M Patel, for her guidance and support throughout the internship. The guidance and insights provided by Akshatha Ma'am were instrumental in shaping my understanding of IP law and its practical applications. The key highlights of what I learned and worked on during my time at Aarde Law Chambers - Trademark & Patent Attorneys, are: 1. Understanding IPR comprehensively, particularly the processes involved in registration and enforcement of rights. 2. Sharpened my research and analytical skills through the in-depth research tasks, analysing of case laws and preparation of research notes. 3. Assisted in the drafting of various legal documents, including counter-statements and replies to Registrar examinations. 4. Witnessed courtroom proceedings at the City Civil Court, which provided real-world perspectives on IP litigation. 5. Discussions with my senior enhanced my learnings of legal strategy, including assessment of settlements, licensing agreements and other alternatives to litigation. This experience has left me with a profound appreciation for the role of IPR in fostering innovation and protecting brands. 🚨 Is Filing a Replication Mandatory? During my internship, I observed that filing a replication is often considered essential, as there is a common perception that the principle of "deemed admission" would otherwise apply. However, based on my research: * Filing a replication is not mandatory in response to a written statement. Courts generally follow the doctrine of "assumed traverse", meaning that in the absence of a replication, it is presumed that the plaintiff denies the new facts raised in the written statement. *When to file a replication: A replication is necessary when the plaintiff wishes to simultaneously admit and deny specific averments in the written statement. The deemed admission principle applies only to the defendant. It does not apply to the plaintiff in the absence of a replication. #civilprocedure #legal procedure #law
