On February 11,2025, within the academic sessions of EGR Power Latam Buenos Aires Summit 2025, we will participate as speaker at the conference “The evolving Latam landscape: Regulatory roundtop and tax tips across Latam markets”. We will make a critical analysis of the latest taxes recently created in Peru and Ecuador that are approved without technical support, in open collision with the constitutional tax principles that limit the exercise of tax power: reservation of law, non-confiscatoriality and equality. Decision-making based on cognitive biases and little knowledge of this industry make that some authorities do not homogenize the tax on all bet games. The authorities created a tax on player’s bets in platforms of licensed non-domiciled and a double tax of 15% on operators and players in Ecuador. In this situations there is nothing left but to turn to the constitutional judge. It would seem that the Judiciary and the Constitutional Court are on a war footing against the tax policies of government in the gambling sector, but ehat happens is that the legislator privileges his prejudices, misinformation and desire to collecte taxes, as if this industry were the goose that lays the golden eggs instead of respecting the human rights of people.
