Not surprising to see this First Nations legal action against the Ontario Mining Act. I suspect it will face significant scrutiny, but I hope it sparks constructive dialogue. It will take time, but finding workable solutions is crucial. The issues involved —climate change/access to critical minerals, Indigenous self-determination/conservation/economic development—are all deeply interconnected. Indigenous voices must be heard, as there's so much at stake for everyone involved. Continue to watch.

The New South Wales (NSW) Labour Government has banned forms of seabed mining in an effort to protect its beaches and coastal environment. Having received support across the NSW Parliament to implement the ban, the Environmental Planning and Assessment Amendment (Seabed Mining and Exploration) Bill 2024 amends the Environmental Planning and Assessment Act 1979 to prohibit seabed petroleum and mineral exploration and recovery in NSW coastal waters. EIA - when and how do we stop assessing GHG impacts? The High Courts recent decision in the West Cumbria Mining case explores the difficulties arising from the Supreme Courts decision in Finch. Any project promoters should be especially wary of advancing 'substitution' arguments (i.e. the same (not greater) GHG emissions will happen anyway) without a clear, robust and objective evidence base for doing so. The case will now be returned to the Secretary of State for redetermination - the application was submitted in 2017. 8 years on and still awaiting a decision. The costs to date for all parties will be astronomical. We desperately need more certainty in the planning system one way or another. A good example of how delay through the Courts (we were waiting a very long time for the Supreme Court to determine Finch) has very serious real world consequences. #planninglaw #environmentallaw #development #EIA #delay

EPA GREENLIGHT FOR WINGELLINA The Minister for Environment has granted an extension to the previous approval for the future development of the #Wingellina Nickel-Cobalt Project in Ministerial Statement No. 1223 as recommended by the Environmental Protection Authority. The updated approval has extended the timeframe of the environmental approval for the Wingellina Project and provides confidence that the Project meets the expectations of the Government, Traditional Owners, #Ngaanyatjarra Council, and residents of Irrunytju, as well as the broader public with respect to the environmental impact assessment.
