This is important for open source software too. One of the things we often look for in a risk assessment is use of unlicensed, copyrighted source code from the web. It’s not just “are you using GPL-licensed libraries”. Chunks of code taken from sites like StackOverflow, GitHub Gist, blogs…and now Copilot. As S. Mike Dierken points out, the absence of an explicit license does not mean it is public domain. Thankfully, years ago StackOverflow starting putting in real license terms for code shared in their platform. GitHub has elevated license awareness on theirs too.
FYI, regarding the kerfluffle around copyright and the Web, in the absence of an explicit license or copyright notice on a web resource, the established legal interpretation generally follows these principles: 1. Automatic Copyright Protection Copyright protection is automatic upon the creation of an original work fixed in a tangible medium of expression. This means that as soon as a web resource (such as text, images, videos, or other content) is created and published, it is protected by copyright law even if no copyright notice is provided. 2. Berne Convention Under the Berne Convention for the Protection of Literary and Artistic Works, to which most countries are signatories, copyright protection does not require registration or a copyright notice. The work is protected from the moment it is created and fixed in a tangible form. 3. Implied Rights and Restrictions In the absence of an explicit license, users cannot assume they have rights to use, copy, distribute, or modify the web resource. The default position is that all rights are reserved by the creator or copyright holder. The lack of a license or notice does not imply that the work is in the public domain or freely usable. Users must seek permission from the copyright holder for any use beyond what is allowed under fair use or other specific exceptions. 4. Fair Use Doctrine Certain uses of copyrighted material may be permitted without the need for permission under the fair use doctrine (in the United States) or similar concepts in other jurisdictions. Fair use typically covers uses such as commentary, criticism, news reporting, teaching, scholarship, and research. However, fair use is determined on a case-by-case basis and depends on factors such as the purpose and character of the use, the nature of the copyrighted work, the amount used, and the effect on the market value of the original work. 5. Assumption of Copyright In practice, the absence of a license or notice means that anyone wishing to use the web resource should assume that it is copyrighted and proceed accordingly by seeking appropriate permissions or licenses from the copyright holder. Key Points - Automatic Protection: Copyright is automatic and does not require registration or notice. - All Rights Reserved: Without a license, all rights are reserved by default. - Permission Needed: Users must seek permission for uses beyond fair use or statutory exceptions. - Fair Use: Limited use may be allowed under fair use or similar doctrines.
