Earlier this week, I presented on the topic "How to Think Like a Lawyer" at the Seattle U Family Business Exchange. Lawyers are taught to think using the “case method”, which helps separate the core issues and evaluate risk. It’s a fun and interactive presentation, and I love that it highlights why lawyers are valuable strategic leaders on your team. After the presentation, Peter Rowan, Executive Director of the FBX program, shared with me his prior research on the nuanced difference between "Risk" and "Uncertainty". And I was fascinated! These terms are often used interchangeably but they are really different - especially in how a leader tackles them. Risk is a known factor – with known probabilities and measurable outcomes. Uncertainty deals with unknown factors where the probabilities of outcomes cannot be accurately estimated due. With Risk, you can apply strategies like legal infrastructure (i.e. contracts, insurance, policies) to manage or mitigate risk. With Uncertainty, you can’t predict the future. Flexibility and adaptability decision-making is the critical success factor. What problems are you currently working on? Consider whether the problem is driven more by Risk or Uncertainty -- or both? How can this distinction help you think differently about your approach? P.S. Firms will need to #demonstrate how they meet these Lloyd's expectations, based on their #maturity and #workforce size (and inherent materiality based on #risk, #resources, sophistication of #data, #systems and #processes).
