#newsalert BASIC EDUCATION LAWS AMENDMENT ACT GAZETTED The Act was gazetted on 16 September 2024 and is not yet in force. This casts an entirely different light on the three months' grace allowed for parties to the Government of National Unity to resolve their differences on matters of school language and admission policy before those provisions take effect. In a speech announcing this concession, President Cyril Ramaphosa tended to give readers the impression that all other provisions would be operationalised immediately. As SA Legal Academy reported at the time, that would have required the publication of a separate presidential proclamation. Yet, at the time of writing, there was no sign of one. Perhaps it would have been prudent to be more transparent about the context in which the concession was made. The Department of Basic Education may well take far longer than three months to prepare for the implementation of the Act's remaining provisions. Why not allow more time to thrash out a compromise position on the vexed issue of school language an admission policy? Or is it government's intention to operationalise the Act in its entirety before the 2025 school year begins? In which case, is there the capacity to do so? These questions need to be asked and answered. The government has halted the Higher Education (Freedom of Speech) Act 2023 six days before it was due to come into force. Bridget Phillipson, the Secretary of State for Education, has said that she is considering options about what to do with the legislation, one of which is to repeal the Act in its entirety because of concerns that it would be burdensome to implement for providers and the Office for Students. #employment #employmentlaw #academicfreedom #freedomofspeech #freedomofexpression #education

Despite a lot of pushback from the National Council of Provinces (NCOP), there are some big changes coming to South African schools. The Basic Education Laws Amendment (BELA) Bill has been met with a lot of criticism, as its amendments include: - The Department of Education having the final say on language and admission policies. - Regulation on school governing bodies. - Making Grade R the new compulsory school-starting age. - Criminalising parents who do not ensure their children are in school. - Regulation of home education. - Confirming the ban on corporal punishment. These amendments generally sound good on paper, but there are concerns about their effectiveness. Many parents struggle to find space for their children in our already overcrowded public school. Turning those parents into criminals doesn’t seem like a solution to the problem. While there are still numerous objections to the bill, the positive response from Parliament's Legal Service means that we are likely to see these changes come into play at some point. What is the meaning of ‘worker’ under Article 45 of the TFEU? The definition of a worker has a very broad scope. There is not a specific Union definition in Article 45 TFEU. It is defined by the case law. Under Levin case, it was argued that once an individual is pursuing or wishing to pursue a genuine and effective economic activity, they would qualify as a worker. In Levin, even if the applicant's income was low, it still raised her standard of living. Therefore, she was a worker. The Levin case also clarified that part-time workers were also covered by the free movement right.
