🚨 BREAKING: New York Becomes the First State to Offer Paid Prenatal Leave! 🚨 This year, New York made history by becoming the first state in the U.S. to offer paid prenatal leave, giving pregnant employees job-protected, paid time off to prioritize their health before giving birth. 💡 Why is this a game-changer? For far too long, paid leave policies have focused solely on postpartum recovery. But pregnancy itself can be physically and emotionally taxing, especially for those experiencing complications. This new law acknowledges a critical truth: Healthy pregnancies lead to healthier moms and healthier babies. Under this new policy, eligible employees can take job-protected leave during pregnancy to attend doctor’s appointments, manage complications, and take the time they need to prepare for childbirth without risking their paycheck. 👏 Governor Kathy Hochul has set a powerful precedent. This policy could pave the way for other states to follow suit — because supporting maternal health is a necessity, not a luxury. New York has made history by becoming the first state in the United States to mandate paid prenatal leave for pregnant employees. On April 22, 2024, Governor Kathy Hochul signed new legislation that expands the New York Paid Family Leave Law ("NY PFL") to provide 20 hours of paid leave for attending prenatal medical appointments. This is a significant move that puts the health and wellbeing of expectant mothers at the forefront. The new law is set to take effect on January 1, 2025. New York Enacts Paid Prenatal Leave Law, Requires Paid Lactation Breaks. Pregnant employees in New York will soon have access to paid leave for prenatal care and paid lactation breaks, thanks to two new laws signed by Gov. Kathy Hochul. Under the prenatal leave law, employers will need to provide up to 20 hours of paid prenatal leave within a 52-week period. This leave can be used for various pregnancy-related health care needs, including physical exams, medical procedures, monitoring, testing, and discussions with health care providers. Importantly, this prenatal care leave is in addition to other existing leave options available to New York employees, such as paid sick and safe leave and paid family leave. New York has set a precedent by becoming the first state to mandate that employers pay for prenatal care leave! On April 20th, Governor Kathy Hochul signed an amendment to the Paid Sick Leave law, requiring employers to offer up to 20 hours of paid prenatal personal leave within a 52-week period. This innovative leave, which can be taken in hourly increments, allows employees to attend healthcare appointments, undergo testing, or receive treatments related to their pregnancy. Employees will be paid at their regular rate or the applicable minimum wage, whichever is higher. This is a significant milestone as it is the first law in the United States to establish a separate paid leave specifically for prenatal care. Plus, starting June 19, 2024, New York will also require paid lactation breaks for nursing employees for up to three years post-childbirth. We commend these progressive steps and hope that other states will follow suit to offer more comprehensive support for working mothers. New York, are you ready for this change? In April, Governor Hochul signed an amendment to New York Labor Law § 196-b. The amendment expands the statewide Paid Family Leave (PFL) policy to provide 20 hours of paid prenatal personal leave per 52-week period for pregnant employees at all New York private sector employers, regardless of size. Beginning January 1, 2025, pregnant workers in New York may have additional paid time off available to them for physical examinations, medical procedures, monitoring and testing, and discussions with a health care provider related to the pregnancy.
