Thanks BDT for this crisp case note on the recent decision in IAG NZ v Degen, which clarifies the extent of Insurer's duties towards clients, and is one of the last pieces of insurance litigation stemming back to the Canterbury Earthquakes. Like it or not, the HC concluded that Insurers do not have a duty to accurately assess claims 🙄. But fear not policy holders, Insurers remain duty bound to disclose all relevant information, act reasonably and process claims within a reasonable time.
